"Herr Präsident! Ich möchte das Hohe Haus auf eine Gefahr aufmerksam machen, die seine Integrität bedroht. In einem vergangene Woche gefällten Urteil britischer Gerichte wird festgestellt, dass nach einem Antrag auf Aufhebung der Immunität eines Abgeordneten, gegen den ein Verfahren läuft, gleichzeitig und implizit davon ausgegangen werden kann, dass das Europäische Parlament ohne weitere Prüfung der Fakten die Immunität bei jeder anderen Anklage ebenfalls aufhebt. Ein solches Urteil stellt eine prima-facie-Verachtung dieses Hohen Hauses dar. Es macht den Weg frei für Pauschalanträge von Mitgliedstaaten und impliziert, dass jede zukünftige Regierung nach eigenem Ermessen vorgehen kann. Wenn nichts dagegen unternommen wird, kann dieses Urteil die Geschäftsordnung dieses Hohen Hauses und seine Arbeitsweise völlig aushebeln. "Señor Presidente, debo llamar la atención de esta Cámara sobre una amenaza a su integridad. La semana pasada, en una sentencia de los tribunales británicos se decía que después de aprobar una solicitud para levantar la inmunidad a un diputado acusado de determinados delitos, se puede considerar simultánea e implícitamente que el Parlamento Europeo levanta también la inmunidad por todas las demás imputaciones sin necesidad de examinar los hechos. Esta sentencia es un verdadero desacato a esta Cámara. Abre el camino para la presentación de solicitudes en blanco de los Estados miembros e implica la posibilidad de que cualquier futuro Gobierno ejerza, a su discreción, solicitudes de este tipo contra todos y cada uno de los diputados. Si no nos oponemos, esta sentencia podría socavar profundamente el Reglamento de esta Cámara y sus procedimientos. Entiendo que este tema sale a la luz a causa de un diputado cuyo escepticismo respecto a esta institución es bien conocido por todos, pero con todo el respeto les recuerdo que yo también soy defensor del Estado de Derecho allí donde se encuentre.

Yhdistyneen kuningaskunnan tuomioistuimissa viime viikolla tehdyssä päätöksessä todettiin, että sen jälkeen kun on hyväksytty pyyntö pidättää sellaisen jäsenen parlamentaarinen koskemattomuus, joka joutuu vastaamaan johonkin syytteeseen, Euroopan parlamentin voidaan olettaa pidättäneen samanaikaisesti ja epäsuorasti parlamentaarisen koskemattomuuden kaikkien mahdollisten muiden syytteiden osalta ilman asiaan liittyvien tosiseikkojen lisätarkastelua. Päätöksellä annetaan ymmärtää, että mikä tahansa tuleva hallitus voi vastaisuudessa esittää hakemuksia ketä tahansa parlamentin jäsentä vastaan oman harkintansa mukaan. Jos tätä päätöstä ei kiistetä, se heikentäisi perinpohjaisesti parlamentin sääntöjä ja menettelytapoja. La semaine dernière, les tribunaux britanniques ont rendu un jugement selon lequel on considérera que le Parlement européen, une fois qu’il aura accepté de lever l’immunité d’un député relativement à des charges spécifiques, aura aussi, simultanément et implicitement, levé l’immunité relativement à toute autre charge, sans autre examen des faits. Un tel jugement est purement et simplement un outrage à notre Assemblée. Il ouvre la voie à des demandes générales de la part des États membres et implique la possibilité de demandes à l’encontre de n’importe quel député, applicables par tout futur gouvernement, à sa discrétion. Si nous ne le contestons pas, ce jugement minera profondément le règlement de cette Assemblée et ses procédures. "Signor Presidente, devo richiamare l’attenzione di quest’Assemblea sulla minaccia che incombe sulla sua integrità. In base a una sentenza emanata la settimana scorsa da un tribunale britannico, se il Parlamento europeo accoglie una richiesta di revoca dell’immunità parlamentare di un deputato cui sono imputate accuse specifiche, si può anche desumere simultaneamente e implicitamente che l’immunità sia revocata anche per qualsiasi altra accusa senza dover ulteriormente esaminare i fatti. Tale sentenza rivela innanzi tutto lo sprezzo per quest’Aula. Apre la strada a richieste a tappeto da parte degli Stati membri e implica la possibilità che qualsiasi governo, a propria discrezione, possa avanzare ogni sorta di richiesta contro qualsivoglia deputato. Se non verrà confutata, questa sentenza comprometterà gravemente il Regolamento interno e le procedure ivi previste. Mi preme rilevare che siffatto problema viene messo in luce dal sottoscritto, un deputato il cui scetticismo verso questa Istituzione è ben noto, ma desidero rispettosamente ricordare all’Assemblea che sono altresì un fautore dello Stato di diritto a tutto tondo.

"Mijnheer de Voorzitter, ik moet de aandacht van dit Parlement vestigen op een kwestie die de integriteit van het Parlement in gevaar brengt. In een Britse gerechtelijke uitspraak vorige week werd gesteld dat het goedkeuren door het Europees Parlement van een verzoek tot opheffing van de immuniteit van een afgevaardigde tegen wie een rechtzaak loopt, automatisch en impliciet betekent dat de immuniteit tegen andere aanklachten ook is opgeheven, zonder verder onderzoek naar de feiten. Een dergelijke uitspraak is op het eerste gezicht een blijk van minachting voor dit Parlement. Deze uitspraak zet de deur open voor verzoeken van lidstaten zonder specifieke grond, hetgeen betekent dat regeringen in de toekomst naar eigen inzicht verzoeken kunnen indienen tegen iedere willekeurige afgevaardigde. Als deze uitspraak niet wordt betwist, betekent dat een ernstige ondermijning van het Reglement van dit Parlement en zijn procedures. Nu wordt deze kwestie weliswaar aan het licht gebracht door een afgevaardigde die bekend staat om zijn scepsis ten aanzien van deze instelling, maar ik wijs u er met alle respect op dat ik ook een voorstander ben van de rechtsstaat waar dan ook.

Numa decisão proferida a semana passada, um tribunal britânico sustenta que, quando o Parlamento Europeu deferir um pedido de levantamento da imunidade de um membro sobre quem recaiam acusações específicas, é lícito inferir que o levantamento em causa é extensivo a quaisquer outras acusações, sem novo exame da matéria de facto. Tal decisão constitui um acto de flagrante desrespeito da autoridade desta Assembleia. Abre a porta à utilização de um mesmo pedido para múltiplos casos por parte dos Estados-Membros e faculta a qualquer governo, de futuro, a possibilidade de recorrer livremente a pedidos de levantamento genéricos contra todo e qualquer deputado. A não ser atacada, a sentença em questão minará profundamente o Regimento e os trabalhos desta Casa. Estou ciente de que a presente chamada de atenção provém de um deputado cujo cepticismo em relação a esta instituição é bem conhecido, mas recordo respeitosamente a V. Exas. que sou também um defensor do primado do direito em todas as suas manifestações.

"Herr talman! Jag måste fästa Europaparlamentets uppmärksamhet på ett hot mot parlamentets integritet. I ett brittiskt domstolsutslag i förra veckan hävdades det att Europaparlamentet, efter att ha godkänt en ansökan om upphävande av immuniteten för en ledamot som det riktats specifika anklagelser mot, samtidigt och underförstått även kan antas ha upphävt immuniteten när det gäller vilka andra anklagelser som helst utan ytterligare granskning av fakta. Ett sådant domstolsutslag är ett uttryck för påtagligt förakt för parlamentet. Det banar väg för generella ansökningar från medlemsstaterna och innebär en möjlighet för vilken framtida regering som helst att efter eget gottfinnande lämna in ansökningar riktade mot vem som helst av parlamentets ledamöter.
