Commissioner, I have a little story for you. Imagine two prisoners, both of whom are citizens of the same Member State and who are both in prison in another Member State. They have committed the same crime. They have received identical sentences. After several years, both are eligible for transfer back to their home Member State. One has behaved beautifully, has been a model prisoner, has repented, has learned and has changed, while the other has behaved very badly, is unreformed and needs more help.
However, and this is the problem I want to draw your attention to, the information on the two prisoners cannot be transferred back across the borders with the prisoners, because present-day data privacy laws prevent the transfer of data across frontiers. This means that the receiving Member State has no idea as to which of the prisoners is a continuing threat, and which is safe to release back into society.

Señor Comisario, me gustaría contarle una breve historia. Imaginemos dos presos, ambos ciudadanos del mismo Estado miembro y encarcelados en otro Estado miembro por el mismo delito. Monsieur le Commissaire, j’ai une petite histoire pour vous. Imaginez deux prisonniers, tous deux citoyens d’un même État membre, tous deux en prison dans un autre État membre. Ils ont commis le même délit. Ils ont reçu des condamnations identiques. Après plusieurs années, tous deux peuvent bénéficier d’un transfèrement vers leur État membre d’origine. L’un s’est bien comporté, il a été un prisonnier modèle, s’est repenti, a étudié et a changé. L’autre, par contre, s’est très mal comporté. Il ne s’est pas amendé et a encore besoin d’aide.
Pourtant, et c’est le problème sur lequel je souhaite attirer votre attention, les informations concernant les deux prisonniers ne peuvent faire l’objet d’un transfert transfrontalier au même titre que les intéressés, car la législation actuelle sur la confidentialité des données empêche le transfert de renseignements d’un pays à un autre. En d’autres termes, l’État membre destinataire ne saura absolument pas lequel des prisonniers constitue toujours une menace et lequel peut reprendre sans risques sa place dans la société.

Signor Commissario, le voglio raccontare un aneddoto. Immagini due detenuti in carcere, entrambi cittadini dello stesso Stato membro ed entrambi in prigione in uno Stato diverso dal loro. Hanno commesso lo stesso crimine, sono stati condannati alla stessa pena. Dopo molti anni entrambi hanno acquisito il diritto di essere trasferiti nello Stato membro di origine. Uno ha tenuto una buona condotta, è stato un detenuto modello, si è pentito, ha imparato dai suoi errori ed è cambiato, mentre l’altro si è comportato molto male, non si è redento e ha bisogno di ulteriore aiuto.
Tuttavia, e questo è il problema sul quale voglio richiamare la sua attenzione, le informazioni sui due detenuti non possono essere trasferite al di fuori dei confini insieme con i detenuti stessi, perché le norme vigenti in materia di tutela dei dati personali vietano il trasferimento di dati attraverso le frontiere. Ciò significa che lo Stato membro che accoglie i condannati non saprà nulla di loro, non saprà quale dei due continui a rappresentare una minaccia e quale invece possa essere reinserito nella società in condizioni di sicurezza.
