I would like to remind the honourable Member that the negotiations on the new EC-Morocco Fisheries Partnership Agreement are concluded and that the Commission and the Moroccan Government initialled the draft agreement in July 2005. With respect to its territorial application, the text of the new agreement is no different from the previous agreement, which ended in 2000.
With regard to the honourable Member’s specific question, I would like to point out that the Polisario Front is not formally accredited with the European Community. There is no formal policy dialogue between the Commission and the Polisario Front. Concerning fisheries negotiations, the Commission has been authorised by the Council to negotiate with the Kingdom of Morocco. It has no mandate to extend the negotiations to third parties.

Ich möchte den Herrn Abgeordneten daran erinnern, dass die Verhandlungen über das neue partnerschaftliche Fischereiabkommen zwischen der EG und Marokko abgeschlossen sind und die marokkanische Regierung den Entwurf des Abkommens im Juli 2005 paraphiert hat. Bezüglich der territorialen Anwendung unterscheidet sich der Text des neuen Abkommens nicht von seinem Vorgänger, der 2000 ausgelaufen ist.
Was die konkrete Frage des Herrn Abgeordneten angeht, so möchte ich darauf hinweisen, dass die Frente Polisário bei der Europäischen Gemeinschaft nicht offiziell akkreditiert ist. Es existiert kein offizieller Dialog zwischen der Kommission und der Frente Polisário. Was die Fischereiverhandlungen betrifft, so wurde die Kommission vom Rat beauftragt, die Verhandlungen mit dem Königreich Marokko zu führen. Sie verfügt über kein Mandat zur Ausweitung der Verhandlungen auf Dritte.
Im Rahmen der Vorbereitungen zu den Verhandlungen über das partnerschaftliche Fischereiabkommen zwischen der EG und Marokko hat die Kommission die politischen, rechtlichen und wirtschaftlichen Auswirkungen eines etwaigen Abkommens evaluiert. Die Kommission ist in diesem Fall wie in anderen Fällen bemüht zu verhindern, dass sich der Abschluss neuer Vereinbarungen im Bereich Fischerei zu einem Faktor in internationalen Streitigkeiten oder Konflikten entwickelt.
Was das partnerschaftliche Fischereiabkommen EG-Marokko und das Problem der Westsahara angeht, so hat sich die Kommission besonders sorgfältig um die Einhaltung der entsprechenden völkerrechtlichen Grundsätze und die Unterstützung der UNO bei der Suche nach einer angemessenen Lösung für die Westsahara bemüht. So wie das vorherige Fischereiabkommen beeinträchtigt der ursprüngliche Wortlaut in keiner Weise das Problem des internationalen Status der Westsahara.

Όσον αφορά το θέμα της συμφωνίας εταιρικής σχέσης ΕΕ-Μαρόκου για την αλιεία και το ζήτημα της Δυτικής Σαχάρας, η Επιτροπή έλαβε ειδική μέριμνα προκειμένου να σεβαστεί πλήρως τις σχετικές αρχές του διεθνούς δικαίου και να υποστηρίξει τις προσπάθειες των Ηνωμένων Εθνών στην εξεύρεση κατάλληλης λύσης σε σχέση με τη Δυτική Σαχάρα. Το περιεχόμενο του αρχικού κειμένου, όπως και στην περίπτωση της προγενέστερης αλιευτικής συμφωνίας, δεν παραβλάπτει επουδενί το θέμα το οποίο συνδέεται με το διεθνές καθεστώς της Δυτικής Σαχάρας.

Quiero recordar a su Señoría que las negociaciones sobre el nuevo acuerdo de cooperación pesquera entre la Unión Europea y Marruecos han concluido y que la Comisión y el Gobierno marroquí rubricaron el proyecto de acuerdo en julio de 2005. En cuanto a su aplicación territorial, el texto del nuevo acuerdo no difiere del acuerdo anterior, que venció en 2000.
Con respecto a la pregunta concreta de su Señoría, quiero señalar que el Frente Polisario no está formalmente acreditado ante la Comunidad Europea. No existe un diálogo político formal entre la Comisión y el Frente Polisario. En cuanto a las negociaciones sobre la pesca, el Consejo ha autorizado a la Comisión a negociar con el Reino de Marruecos. No tiene competencias para ampliar las negociaciones a terceros.

"Haluan muistuttaa arvoisalle parlamentin jäsenelle, että neuvottelut uudesta EY:n ja Marokon kalastuskumppanuussopimuksesta on saatu päätökseen ja että komissio ja Marokon hallitus parafoivat sopimusluonnoksen heinäkuussa 2005. Uuden sopimuksen teksti on alueellisen soveltamisalansa osalta täysin samanlainen kuin sitä edeltänyt sopimus, jonka voimassaolo päättyi vuonna 2000.
Arvoisan parlamentin jäsenen kysymykseen vastatakseni haluan huomauttaa, ettei Euroopan yhteisö ole tunnustanut virallisesti Länsi-Saharan vapautusjärjestöä eli Polisario-rintamaa. Komission ja vapautusjärjestön välillä ei ole virallista poliittista vuoropuhelua. Je tiens à rappeler à l’honorable parlementaire que les négociations sur le nouvel accord de partenariat dans le secteur de la pêche entre la Communauté européenne et le Royaume du Maroc sont terminées et que la Commission et le gouvernement marocain ont commencé à rédiger le projet d’accord en juillet 2005. S’agissant de son application territoriale, le texte du nouvel accord ne diffère aucunement de l’accord précédent, venu à terme en 2000.
En ce qui concerne la question spécifique de l’honorable parlementaire, je tiens à signaler que le Front Polisario n’est pas formellement accrédité auprès de la Communauté européenne. Il n’existe aucun dialogue politique formel entre la Commission et le Front Polisario. Pour ce qui est des négociations sur la pêche, la Commission a été autorisée par le Conseil à négocier avec le Royaume du Maroc. Elle ne dispose d’aucun mandat pour étendre les négociations à d’autres parties.

"Vorrei ricordare all’onorevole deputato che i negoziati per il nuovo accordo di partenariato nel settore della pesca CE-Marocco sono conclusi e che la Commissione ha iniziato a lavorare al progetto di accordo insieme al governo marocchino nel luglio 2005. Per quanto riguarda la sua applicazione territoriale, il testo del nuovo accordo non differisce da quello del precedente accordo scaduto nel 2000.
Riguardo alla specifica domanda dell’onorevole deputato vorrei precisare che il Fronte Polisario non è accreditato presso la Comunità europea. Non esiste un dialogo politico formale tra la Commissione e il Fronte Polisario. Per quanto riguarda i negoziati sulla pesca, la Commissione è stata autorizzata dal Consiglio a condurre gli stessi con il Regno del Marocco. Il suo mandato non prevede la possibilità di estendere i negoziati a terzi.
In sede di preparazione dei negoziati per l’accordo di partenariato nel settore della pesca CE-Marocco, la Commissione ha valutato attentamente le implicazioni politiche, giuridiche ed economiche di un eventuale accordo. In questo, come in altri casi, la Commissione si sta adoperando per evitare che nuovi accordi in materia di pesca possano dare adito a controversie o conflitti internazionali.

"Ik wil de afgevaardigde eraan herinneren dat de onderhandelingen over de nieuwe partnerschapsovereenkomst inzake visserij tussen de EG en Marokko zijn afgerond en dat de Commissie en de Marokkaanse regering de ontwerpovereenkomst in juli 2005 hebben ondertekend. "Gostaria de lembrar ao senhor deputado que as negociações sobre o novo acordo de parceria entre a Comunidade Europeia e o Reino de Marrocos relativamente ao sector das pescas estão concluídas e que a Comissão e o Governo de Marrocos rubricaram o projecto de acordo em Julho de 2005. Com respeito à sua aplicação territorial, o texto do novo acordo não é diferente do do acordo anterior, que expirou em 2000.
Com respeito à pergunta específica do senhor deputado, gostaria de lhe dizer que a Frente Polisário não está formalmente acreditada junto da Comunidade Europeia. Não há diálogo político formal entre a Comissão e a Frente Polisário. Jag skulle vilja påminna ledamoten om att förhandlingarna om det nya avtalet om fiskepartnerskap mellan Europeiska gemenskapen och Marocko har avslutats och att kommissionen och den marockanska regeringen undertecknade förslaget till avtal i juli 2005. När det gäller den territoriella tillämpningen skiljer sig inte texten i det nya avtalet från det tidigare avtalet, som löpte ut 2000.
Med tanke på ledamotens specifika fråga skulle jag vilja påpeka att Polisariofronten formellt inte är erkänd av Europeiska gemenskapen. Det finns ingen formell politisk dialog mellan kommissionen och Polisario. När det gäller fiskeförhandlingar har rådet bemyndigat kommissionen att förhandla med Konungariket Marocko. Den har inga mandat att utvidga förhandlingarna till tredje part.
Inom ramen för förberedelserna inför förhandlingarna om avtalet om fiskepartnerskap mellan Europeiska gemenskapen och Marocko utvärderade kommissionen noga de politiska, rättsliga och ekonomiska följderna av ett eventuellt avtal. I detta fall, som alltid, anstränger sig kommissionen för att undvika en situation där slutsatsen i det nya avtalet på fiskeriområdet skulle kunna orsaka internationella tvister eller konflikter.
När det gäller ärendet med avtalet om fiskepartnerskap mellan Europeiska gemenskapen och Marocko och frågan om Västsahara ansträngde sig kommissionen särskilt för att fullständigt respektera de berörda principerna i internationell rätt och att stödja Förenta nationernas ansträngningar för att finna en passande lösning när det gäller Västsahara. Innehållet i den inledande texten, som i fallet med tidigare fiskeavtal, påverkar inte på något sätt den fråga som hör samman med Västsaharas internationella status.
Kommissionen är övertygad om att det nya avtalet om fiskepartnerskap mellan Europeiska gemenskapen och Marocko överensstämmer med internationell rätt och med yttrandet från FN:s juridiska rådgivare av den 29 januari 2002.
