Mr President, before outlining the Commission's position on this dossier, let me first thank the Committee on Fisheries and especially the rapporteur, Mrs Fraga Estévez, for her excellent work carried out within the very tight deadlines. Amendment 6 cannot be accepted by the Commission. The Commission has established a constant dialogue with the industry within the framework of a special sectoral group. This group meets on a regular basis and discusses upcoming negotiations and any other technical issues. In addition, experts from Member States are invited to be present during the negotiations of a fisheries agreement or protocol. I am happy to be able to present to you the draft proposal for the conclusion of the Protocol setting out the tuna fishing opportunities and financial contribution under the EEC-Comoros Agreement. As the honourable Members know, the Community has a longstanding relation with the Comoros in the fisheries area. The first fisheries agreement with the country dates back to 1988. Although it is the smallest tuna agreement, it is of importance due to the strategic location of this fishery in the Indian Ocean as well as for the fishing possibilities obtained. The new Protocol, which was initialled on 24 November 2004, covers a 6-year period from 1 January 2005 to 31 December 2010. The protocol grants fishing opportunities for 40 tuna seiners and 17 surface longliners and has a financial contribution of EUR 390 000 per year. The agreement is one that is of mutual benefit to both parties and contains a number of new elements including the following. Firstly, an exclusivity clause, which prohibits the existence of private licences or other private arrangements outside the scope of the Agreement. Secondly, a VMS requirement to reinforce checks on vessels operating in Comorian waters. Thirdly, the social clause applicable to local seamen signed on by Community vessels. Fourthly, rules on taking on board observers and, fifthly, adjustment of the share-out of the cost of the Agreement between the Community and shipowners from a ratio of EUR 75/25 per tonne to EUR 65/35 per tonne, which is already applied in other tuna agreements in the Pacific. This increase of the shipowners' share of the cost will gradually be applied to all tuna agreements in the Community as was called for in the reform of the common fisheries policy. I believe that these new elements introduced in dialogue with the Comoros authorities and according to the principles set out in the new Fisheries Partnership Agreements will ensure that the Comoros Agreement contributes to responsible and sustainable fisheries in the Comoros. This work includes the establishment of annual and multi-annual objectives, the distribution of the part of the financial compensation – 60%, the aims to be attained and criteria and procedures in order to allow for an evaluation of the yearly results obtained in accordance with Article 7 of the Protocol. Let me now turn to the amendments. On Amendment 1, the Commission is of the opinion that this is not necessary, given that the procedure for the adoption of the new Framework Agreement – the Fisheries Partnership Agreement – will soon be launched. On Amendments 2, 3 and 5, the Commission is entirely in agreement with their spirit. However, the Commission already complies with the transmission of this kind of information in line with both the current inter-institutional arrangements and in particular with the Framework Agreement between the Commission and the European Parliament. Therefore, the Commission considers that these amendments are not necessary. On Amendment 4, may I recall the basic Community provisions concerning the mandate of the Commission to negotiate on behalf of the Community. Wie den Damen und Herren Abgeordneten bekannt ist, unterhält die Gemeinschaft schon seit langem Fischereibeziehungen mit den Komoren. Das erste Fischereiabkommen mit dem Land geht auf das Jahr 1988 zurück. Obwohl es das kleinste Thunfischabkommen ist, hat es sowohl aufgrund der strategisch günstigen Lage der Fanggebiete im Indischen Ozean als auch aufgrund der erhaltenen Fangmöglichkeiten große Bedeutung. Das neue Protokoll, das am 24. November paraphiert wurde, hat eine sechsjährige Laufzeit vom 1. Januar 2005 bis 31. Dezember 2010. Das Protokoll gewährt Fangmöglichkeiten für 40 Thunfischwadenfänger und 17 Oberflächenlangleinenfischer bei einer finanziellen Gegenleistung von 390 000 Euro pro Jahr. Das Abkommen ist von beiderseitigem Nutzen für die Parteien und enthält eine Reihe neuer Elemente, unter anderem folgende: zunächst eine Ausschließlichkeitsklausel, die neben dem Fischereiabkommen mit der Gemeinschaft private Lizenzen und andere private Vereinbarungen außerhalb des Geltungsbereichs des Abkommens ausschließt. Diese Erhöhung der Kostenbeteiligung für die Reeder wird schrittweise in allen Thunfischabkommen der Gemeinschaft eingeführt, so wie es im Zuge der Reform der Gemeinsamen Fischereipolitik gefordert wurde. Ich bin überzeugt, dass diese neuen Elemente, die im Dialog mit den komorischen Behörden und gemäß den Grundsätzen der neuen partnerschaftlichen Fischereiabkommen aufgenommen wurden, sicherstellen werden, dass das Abkommen mit den Komoren zu einer verantwortungsbewussten und nachhaltigen Fischerei in den Gewässern der Komoren führt. Bestandteil des Abkommens sind auch die Festlegung jährlicher und mehrjähriger Zielvorgaben, die Verwendung eines Teils der finanziellen Gegenleistung, nämlich 60 %, die damit zu erreichenden Ziele und die Kriterien und Verfahren, die eine jährliche Bewertung der Ergebnisse gemäß Artikel 7 des Protokolls ermöglichen sollen. Lassen Sie mich nun zu den Änderungsanträgen kommen. In Bezug auf Änderungsantrag 1 ist die Kommission der Auffassung, dass er nicht notwendig ist, da das Verfahren zur Annahme des neuen Rahmenabkommens – des partnerschaftlichen Fischereiabkommens – bald eingeleitet wird. Όπως γνωρίζουν οι αξιότιμοι βουλευτές, η Κοινότητα διατηρεί μακροχρόνιες σχέσεις με τις Νήσους Κομόρες στον τομέα της αλιείας. Η πρώτη συμφωνία για την αλιεία με τη χώρα αυτή συνήφθη το 1988. Αν και είναι η μικρότερη συμφωνία για τον τόνο, είναι σημαντική λόγω της στρατηγικής θέσης αυτού του τύπου αλιείας στον Ινδικό Ωκεανό καθώς και των αλιευτικών δυνατοτήτων που παρέχει. Señor Presidente, antes de exponer la posición de la Comisión en este expediente, permítame dar las gracias a la Comisión de Pesca y, muy especialmente, a la ponente, la señora Fraga Estévez, por la excelente labor que ha llevado a cabo en un plazo tan ajustado. La Comisión no puede aceptar la enmienda 6. La Comisión ha entablado un diálogo permanente con el sector en el marco de un grupo sectorial especial. Este grupo se reúne periódicamente para deliberar sobre las próximas negociaciones y otras cuestiones técnicas. Además se invita a expertos de los Estados miembros para que estén presentes durante las negociaciones de los acuerdos o protocolos de pesca. Me complace poder presentar a sus Señorías el proyecto de propuesta para la celebración del protocolo por el que se establecen las oportunidades de pesca de atún y la contribución financiera en el marco del Acuerdo CEE-Comores. Como saben sus Señorías, la Comunidad mantiene una relación desde hace largo tiempo con la zona pesquera de las Comores. El primer acuerdo pesquero con este país se remonta a 1988. Aunque se trata del acuerdo atunero de menor envergadura, su importancia se debe a la ubicación estratégica de sus caladeros en el Océano Índico, así como a las posibilidades de pesca obtenidas. El nuevo Protocolo, que fue rubricado el 24 de noviembre de 2004, abarca un período de seis años, del 1 de enero de 2005 al 31 de diciembre de 2010. El Protocolo concede oportunidades de pesca para 40 atuneros cerqueros y 17 palangreros de superficie, y contempla una contribución financiera de 390 000 euros anuales. El acuerdo es de beneficio mutuo para ambas partes y recoge una serie de elementos nuevos, entre los que destacan los siguientes: En primer lugar, una cláusula de exclusividad, que prohíbe la existencia de licencias privadas u otros acuerdos privados fuera del ámbito del Acuerdo. En segundo lugar, la obligación de establecer un sistema de seguimiento de buques para reforzar las inspecciones realizadas en los buques que faenan en aguas de las Comores. En tercer lugar, una cláusula social de aplicación a los marineros locales contratados por buques comunitarios. En cuarto lugar, normas relativas a la presencia a bordo de observadores, y en quinto y último lugar, el ajuste de la distribución del coste del Acuerdo entre la Comunidad y los armadores en una proporción situada entre 65/35 % y 75/25 %, que ya se aplica en otros acuerdos atuneros en el Pacífico. Este aumento de la cuota de los armadores en el coste del Acuerdo se aplicará progresivamente a todos los acuerdos atuneros de la Comunidad, como se exige en la reforma de la Política Pesquera Común. Creo que estos nuevos elementos introducidos mediante el diálogo con las autoridades de Comores y que coinciden con los principios que figuran en los nuevos Acuerdos de asociación en materia de pesca garantizarán que el Acuerdo con las Comores contribuya a una pesca responsable y sostenible en las aguas de este país. Esta labor contempla igualmente el establecimiento de objetivos anuales y plurianuales, la distribución de parte de la compensación financiera –un 60 %–, los objetivos que se desean alcanzar y los criterios y procedimientos que permitan evaluar los resultados anuales obtenidos de conformidad con el artículo 7 del Protocolo. This group meets on a regular basis and discusses upcoming negotiations and any other technical issues. In addition, experts from Member States are invited to be present during the negotiations of a fisheries agreement or protocol. I am happy to be able to present to you the draft proposal for the conclusion of the Protocol setting out the tuna fishing opportunities and financial contribution under the EEC-Comoros Agreement. As the honourable Members know, the Community has a longstanding relation with the Comoros in the fisheries area. The first fisheries agreement with the country dates back to 1988. Although it is the smallest tuna agreement, it is of importance due to the strategic location of this fishery in the Indian Ocean as well as for the fishing possibilities obtained. The new Protocol, which was initialled on 24 November 2004, covers a 6-year period from 1 January 2005 to 31 December 2010. The protocol grants fishing opportunities for 40 tuna seiners and 17 surface longliners and has a financial contribution of EUR 390 000 per year. The agreement is one that is of mutual benefit to both parties and contains a number of new elements including the following. Firstly, an exclusivity clause, which prohibits the existence of private licences or other private arrangements outside the scope of the Agreement. Secondly, a VMS requirement to reinforce checks on vessels operating in Comorian waters. Thirdly, the social clause applicable to local seamen signed on by Community vessels. Fourthly, rules on taking on board observers and, fifthly, adjustment of the share-out of the cost of the Agreement between the Community and shipowners from a ratio of EUR 75/25 per tonne to EUR 65/35 per tonne, which is already applied in other tuna agreements in the Pacific. Esso concede possibilità di pesca a 40 tonniere con reti a circuizione e a 17 pescherecci con palangari di superficie; prevede un contributo finanziario di 390 000 euro all’anno. L’accordo è vantaggioso per entrambe le parti, e prevede numerosi elementi nuovi, tra cui i seguenti: in primo luogo, una clausola di esclusività, che vieta le licenze private o altri accordi della stessa natura al di fuori dei limiti dell’accordo. In secondo luogo, un requisito VMS per rendere più rigorosi i controlli sulle navi operanti in acque comoriane. In terzo luogo, la clausola sociale applicabile ai marinai locali ingaggiati su navi comunitarie. Innan jag redogör för kommissionens ställningstagande till denna fråga vill jag först tacka fiskeriutskottet och särskilt föredraganden Carmen Fraga Estévez för det utmärkta arbete hon har gjort inom den mycket snäva tidsramen. Det nya protokollet, som undertecknades den 24 november 2004, täcker en sexårsperiod från den 1 januari 2005 till den 31 december 2010. Enligt protokollet får EU fiskemöjligheter för 40 notfartyg för tonfisk och 17 ytlångrevsfartyg mot att vi betalar ekonomisk ersättning på 390 000 EUR per år. Avtalet är utformat så att det gagnar båda parter och innehåller ett antal nya delar, däribland följande: För det första en exklusivitetsklausul, som förhindrar förekomsten av privata licenser eller andra privata uppgörelser utanför avtalets ram. För det andra krav på ett satellitbaserat system för övervakning av fartyg (VMS) för att förstärka kontrollen av fartyg som rör sig på komoriskt vatten. För det tredje den sociala klausulen som gäller lokala sjömän som mönstrar på gemenskapens fartyg. För det fjärde bestämmelser för påmönstring av observatörer och för det femte en ändring av fördelningen av avtalets kostnader mellan gemenskapen och fartygsägarna från ett förhållande på 75/25 euro per ton till 65/35 euro per ton, vilket redan gäller för andra tonfiskavtal i Stilla havet. Denna ökning av fartygsägarnas andel av kostnaden kommer efterhand att genomföras i alla avtal om tonfisk i gemenskapen, något som reformeringen av den gemensamma fiskepolitiken har krävt. Jag anser att dessa nya delar som har införts i dialog med de komoriska myndigheterna och enligt principerna i de nya fiskepartnerskapsavtalen kommer att garantera att avtalet med Komorerna bidrar till ett ansvarsfullt och hållbart fiske i Komorerna. Detta arbete inbegriper upprättandet av ettåriga och fleråriga mål, fördelningen av den ekonomiska kompensationen – 60 procent, de mål som måste uppnås samt kriterier och förfaranden för att möjliggöra en utvärdering av de årliga resultaten enligt artikel 7 i protokollet. Låt mig nu gå över till ändringsförslagen. När det gäller ändringsförslag 1 anser kommissionen att detta inte är nödvändigt med tanke på att förfarandet för att anta det nya ramavtalet – fiskepartnerskapsavtalet – snart kommer att inledas. När det gäller ändringsförslagen 2, 3 och 5 instämmer kommissionen helt med andan i dessa förslag. Kommissionen beaktar dock redan överlämnandet av denna typ av information i linje med både den rådande interinstitutionella ordningen och i synnerhet med ramavtalet mellan kommissionen och Europaparlamentet. Därför anser kommissionen att dessa ändringsförslag inte är nödvändiga. När det gäller ändringsförslag 4 får jag erinra om de grundläggande gemenskapsbestämmelserna om kommissionens mandat att förhandla på gemenskapens vägnar. Rådet har gett kommissionen mandat att förhandla om avtal och överenskommelser om fiske mellan gemenskapen och Komorerna. Mot denna bakgrund krävs det inget nytt mandat för att avtalet ska kunna förlängas periodiskt."@sv21
