Mr President, the fight against money laundering and terrorist financing is a political priority for the European Union. The Commission adopted this proposal for a third directive on the fight against money laundering and terrorist financing less than a year ago! And today it is before this House. This testifies to the importance of this text.
Work has progressed fast because all the institutions of the European Union have been fully dedicated to ensuring that the European Union is equipped with state
of
the
art defences in the field. This directive builds on existing Community texts and incorporates into Community law the revised 40 recommendations of the Financial Action Task Force on money laundering and terrorist financing.
The directive tightens the controls in the financial sector against money launderers and terrorist financers and strengthens cooperation between countries. Not only will the fight against money laundering and terrorist financing benefit from this, but so will the integrity and stability of the financial sector. The EU is also setting an example for other countries in the world to follow and match.
The third anti
money laundering directive will prohibit money laundering as well as terrorist financing. It is applicable to the financial sector as well as to lawyers, notaries, accountants, real estate agents and casinos, trust and company service providers as well as all providers of goods when payments are made in cash in excess of EUR 15 000. These people need, firstly, to identify and verify the identity of their customer and of its beneficial owner and to monitor transactions with the customer, while taking into account a risk
based approach; secondly, to report suspicions on money laundering and terrorist financing to the national financial intelligence unit; and, thirdly, to take supporting measures, such as record keeping, training of personnel and the establishment of internal policies and procedures. The directive is completed with a section on supervision and offers the possibility to take implementing measures.
With this updated system we have progressed enormously. I should like in particular to underline the following elements.
The cooperation between the European Parliament, the presidency and the Commission on this directive has been extremely constructive. This shows not only the willingness to have a fast
track adoption at first reading, but also the priority that all of us give to combating money laundering and fighting terrorist financing.
Furthermore, I especially appreciated the fact that we have all shown a sincere desire to achieve a compromise on the main issues, i.e. the definition of the beneficial owner, the definition of and the application of enhanced due diligence in respect of politically exposed persons, the coverage of trusts and lawyers and last, but not least, comitology.
In respect of comitology, I underline that in the actual situation the Commission as a maximum is willing to accept a sunset clause. This clause provides for the suspension of the comitology procedure four years after the entry into force of the directive. In accordance with Article 251 of the Treaty, these measures may be renewed by Parliament and the Council on a proposal from the Commission.

Kommissionen vedtog forslaget om et tredje direktiv om bekæmpelse af hvidvaskning af penge og finansiering af terrorisme for mindre end et år siden! Og i dag er det til behandling her i Parlamentet. Det vidner om tekstens betydning.
Arbejdet er skredet hurtigt frem, fordi alle EU's institutioner har været opsatte på at sikre, at EU udstyres med det bedst mulige forsvar på dette område. Direktivet bygger videre på de eksisterende fællesskabstekster og tilføjer fællesskabsretten de 40 ændrede henstillinger fra Den Finansielle Aktionsgruppe vedrørende Hvidvaskning af Penge og Finansiering af Terrorisme.

De pågældende skal for det første identificere og kontrollere kundens og den endelige ejers identitet og overvåge transaktioner med kunden ud fra en risikobaseret strategi. For det andet skal de indberette mistanke om hvidvaskning af penge og finansiering af terrorisme til de nationale finansielle efterretningsenheder, og for det tredje skal de træffe støtteforanstaltninger såsom registrering, uddannelse af personale og indførelse af interne politikker og procedurer. Direktivet har fået tilføjet et afsnit om overvågning og giver mulighed for, at der kan træffes gennemførelsesforanstaltninger.
Dette opdaterede system har betydet, at vi har gjort kolossale fremskridt. Jeg vil især understrege følgende elementer:
Samarbejdet mellem Europa-Parlamentet, formandskabet og Kommissionen om dette direktiv har været yderst konstruktivt. Det afspejler ikke blot viljen til at få en hurtig vedtagelse ved førstebehandlingen, men også hvor højt vi alle prioriterer bekæmpelsen af hvidvaskning af penge og bekæmpelsen af terrorisme.
Desuden værdsatte jeg i særdeleshed det faktum, at alle har udvist et oprigtigt ønske om at nå frem til et kompromis om hovedpunkterne, dvs. definitionen af den endelige ejer, definitionen og gennemførelsen af skærpede kundeidentifikationskrav i forhold til politisk udsatte personer, dækning af trusts og advokater og sidst men ikke mindst komitologi.
Jeg skal i forhold til kommitologispørgsmålet understrege, at Kommissionen i den nuværende situation maksimalt er villig til at acceptere en ophørsklausul. Ifølge denne klausul ophæves kommitologiproceduren fire år efter direktivets ikrafttrædelse. Ifølge traktatens artikel 251 kan foranstaltningerne forlænges af Parlamentet og Rådet efter forslag fra Kommissionen.

"Herr Präsident! Der Kampf gegen Geldwäsche und die Finanzierung des Terrorismus hat für die Europäische Union politische Priorität. Die Kommission hat diesen Vorschlag für eine dritte Richtlinie im Bereich der Bekämpfung der Geldwäsche und Finanzierung des Terrorismus vor weniger als einem Jahr verabschiedet! Heute liegt er bereits diesem Hause vor. Das zeigt die Bedeutung dieses Textes.
Die Arbeit ist schnell vorangegangen, weil alle Institutionen der Europäischen Union sich entschlossen dafür eingesetzt haben, die Ausstattung der Europäischen Union mit hochmodernem Schutz auf diesem Gebiet sicherzustellen. Die Richtlinie baut auf vorhandenen Texten der Gemeinschaft auf und nimmt die überarbeiteten 40 Empfehlungen der Arbeitsgruppe Finanzielle Maßnahmen gegen die Geldwäsche und die Finanzierung des Terrorismus in das Gemeinschaftsrecht auf.
Sie verschärft die Kontrollen im Finanzsektor gegen Geldwäscher und die Finanziers terroristischer Handlungen und stärkt die Zusammenarbeit zwischen den Ländern. Hiervon wird nicht nur der Kampf gegen Geldwäsche und die Finanzierung des Terrorismus, sondern auch die Integrität und Stabilität des Finanzsektors profitieren. Damit ist die EU auch für andere Länder der Welt ein nachahmenswertes Vorbild.
Die dritte Richtlinie im Bereich Geldwäsche verbietet sowohl Geldwäsche als auch die Finanzierung von Terrorismus. Sie gilt für den Finanzsektor wie auch für Anwälte, Notare, Abschlussprüfer, Immobilienmakler und Casinos, Treuhand- und Unternehmensdienstleister sowie alle Anbieter von Waren, wenn Zahlungen von mehr als 15 000 EUR in bar erfolgen. Diese Personengruppen müssen erstens die Identität ihrer Kunden und des wirtschaftlichen Eigentümers feststellen und überprüfen und Transaktionen mit dem Kunden beobachten, wobei ein risikosensitiver Ansatz zu berücksichtigen ist; zweitens, einen Verdacht auf Geldwäsche und Terrorismusfinanzierung den nationalen Meldestellen mitteilen; und drittens ergänzende Maßnahmen wie das Aufbewahren von Aufzeichnungen, die Schulung des Personals und die Festlegung interner Politiken und Verfahren einleiten. Ferner enthält die Richtlinie einen Abschnitt über die Überwachung und bietet die Möglichkeit, Durchführungsmaßnahmen zu erlassen.
Mit diesem aktualisierten System sind wir einen riesigen Schritt vorangekommen. Insbesondere möchte ich die folgenden Elemente unterstreichen:
Europäisches Parlament, Präsidentschaft und Kommission haben bei dieser Richtlinie außerordentlich konstruktiv zusammengearbeitet. Dies zeigt nicht nur die Bereitschaft zu einer raschen Annahme in erster Lesung, sondern auch der Vorrang, den wir alle der Bekämpfung von Geldwäsche und dem Kampf gegen die Terrorismusfinanzierung beimessen.
Darüber hinaus hat mich ganz besonders gefreut, dass wir alle ernsthaft bemüht waren, in den Hauptfragen einen Kompromiss zu erzielen, also Definition des wirtschaftlichen Eigentümers, Definition und Anwendung verstärkter Sorgfaltspflicht bei politisch exponierten Personen, Einbeziehung von Treuhandgesellschaften und Anwälten und nicht zuletzt die Komitologieregelung.
Was die Komitologieregelung anbelangt, möchte ich unterstreichen, dass die Kommission in der gegenwärtigen Situation höchstens dazu bereit ist, eine Klausel über eine begrenzte Geltungsdauer zu akzeptieren. Diese Klausel sieht die Aussetzung des Komitologieverfahrens vier Jahre nach Inkrafttreten der Richtlinie vor. Gemäß Artikel 251 des Vertrages können diese Maßnahmen auf Vorschlag der Kommission von Parlament und Rat verlängert werden.
Ich möchte dem Parlament schon jetzt für die Ermöglichung einer Einigung in erster Lesung danken, und insbesondere beglückwünsche ich Herrn Nassauer, Herrn Muscat und die Schattenberichterstatter herzlich zur Qualität ihrer Arbeit und danke ihnen für den außerordentlich konstruktiven Geist, in dem sie diesen Bericht verfassten."@de9
"Κύριε Πρόεδρε, η καταπολέμηση της νομιμοποίησης εσόδων από παράνομες δραστηριότητες και της χρηματοδότησης της τρομοκρατίας είναι πολιτική προτεραιότητα για την Ευρωπαϊκή Ένωση. Η Επιτροπή ενέκρινε αυτή την πρόταση σχετικά με μια τρίτη οδηγία για την καταπολέμηση της νομιμοποίησης εσόδων από παράνομες δραστηριότητες και της χρηματοδότησης της τρομοκρατίας πριν από λιγότερο από ένα έτος! Και σήμερα βρίσκεται ενώπιον αυτού του Κοινοβουλίου. Αυτό μαρτυρεί τη σπουδαιότητα αυτού του κειμένου.
Οι εργασίες προχώρησαν γρήγορα επειδή όλα τα θεσμικά όργανα της Ευρωπαϊκής Ένωσης κατέβαλαν κάθε δυνατή προσπάθεια προκειμένου να διασφαλίσουν ότι η Ευρωπαϊκή Ένωση είναι εξοπλισμένη με άμυνες του υψηλότερου επιπέδου στον τομέα. Αυτή η οδηγία βασίζεται σε υφιστάμενα κοινοτικά κείμενα και ενσωματώνει στο κοινοτικό δίκαιο τις 40 αναθεωρημένες συστάσεις της Ομάδας Εργασίας «χρηματοοικονομική δράση για την καταπολέμηση της νομιμοποίησης εσόδων από παράνομες δραστηριότητες και της χρηματοδότησης της τρομοκρατίας».
Η οδηγία καθιστά αυστηρότερους τους ελέγχους στον χρηματοπιστωτικό τομέα κατά των επιδιδόμενων σε νομιμοποίηση εσόδων από παράνομες δραστηριότητες και των χρηματοδοτών της τρομοκρατίας και ενισχύει τη συνεργασία μεταξύ των χωρών. Δεν θα διευκολύνει απλώς την καταπολέμηση της νομιμοποίησης εσόδων από παράνομες δραστηριότητες και της χρηματοδότησης της τρομοκρατίας, αλλά παράλληλα θα προωθήσει την ακεραιότητα και τη σταθερότητα του χρηματοπιστωτικού τομέα. Η ΕΕ αποτελεί παράδειγμα που πρέπει να ακολουθήσουν και να συναγωνιστούν οι υπόλοιπες χώρες του κόσμου.
Η τρίτη οδηγία κατά της νομιμοποίησης εσόδων από παράνομες δραστηριότητες θα απαγορεύσει και τη νομιμοποίηση εσόδων από παράνομες δραστηριότητες και τη χρηματοδότηση της τρομοκρατίας. Είναι εφαρμοστέα τόσο στον χρηματοπιστωτικό τομέα όσο και στους δικηγόρους, τους συμβολαιογράφους, τους λογιστές, τους κτηματομεσίτες και τα καζίνο, τις εταιρείες καταπιστευτικής διαχείρισης και τις επιχειρήσεις καθώς και στους προμηθευτές αγαθών για πληρωμές τοις μετρητοίς μεγαλύτερες των 15 000 ευρώ. Αυτοί οι άνθρωποι πρέπει, πρώτον, να προσδιορίσουν και να επαληθεύσουν την ταυτότητα του πελάτη τους και του δικαιούχου του και να ελέγχουν τις συναλλαγές με τον πελάτη, λαμβάνοντας ταυτόχρονα υπόψη μια προσέγγιση με βάση τον κίνδυνο· δεύτερον, να αναφέρουν υποψίες σχετικά με τη νομιμοποίηση εσόδων από παράνομες δραστηριότητες και τη χρηματοδότηση της τρομοκρατίας στην εθνική μονάδα χρηματοοικονομικού ελέγχου· και, τρίτον, να λαμβάνουν υποστηρικτικά μέτρα, όπως η τήρηση αρχείων, η κατάρτιση προσωπικού και η θέσπιση εσωτερικών πολιτικών και διαδικασιών. Η συνεργασία μεταξύ του Ευρωπαϊκού Κοινοβουλίου, της Προεδρίας και της Επιτροπής σχετικά με αυτή την οδηγία υπήρξε εξαιρετικά εποικοδομητική. Αυτό δείχνει όχι μόνο την πρόθεση για δυνατότητα ταχείας έγκρισης στην πρώτη ανάγνωση, αλλά επίσης την προτεραιότητα που όλοι μας δίνουμε στην καταπολέμηση της νομιμοποίησης εσόδων από παράνομες δραστηριότητες και της χρηματοδότησης της τρομοκρατίας.
Επιπλέον, εκτίμησα ιδιαίτερα το γεγονός ότι όλοι επιδείξαμε την ειλικρινή βούληση να επιτύχουμε συμβιβασμό στα κύρια θέματα, λ.χ. στον προσδιορισμό του δικαιούχου, στον προσδιορισμό και την επιβολή ενισχυμένου βαθμού επιμέλειας όσον αφορά πρόσωπα που εκτίθενται πολιτικά, στην κάλυψη των εταιρειών καταπιστευτικής διαχείρισης και των δικηγόρων και, τελευταίο αλλά εξίσου σημαντικό, στην επιτροπολογία.
Όσον αφορά την επιτροπολογία, υπογραμμίζω ότι, ως έχει σήμερα η κατάσταση, η Επιτροπή είναι πρόθυμη να δεχτεί το πολύ μια ρήτρα λήξεως ισχύος. Αυτή η ρήτρα προβλέπει την αναστολή της διαδικασίας επιτροπολογίας τέσσερα χρόνια μετά την έναρξη ισχύος της οδηγίας. Σύμφωνα με το άρθρο 251 της Συνθήκης, αυτά τα μέτρα μπορούν να ανανεωθούν από το Κοινοβούλιο και το Συμβούλιο κατόπιν πρότασης της Επιτροπής.

Señor Presidente, la lucha contra el blanqueo de capitales y la financiación del terrorismo es una prioridad política de la Unión Europea. La Comisión aprobó esta propuesta de tercera Directiva relativa a la lucha contra el blanqueo de capitales y la financiación del terrorismo hace menos de un año. Y hoy la tenemos ya en este Parlamento. Eso demuestra la importancia del texto.
El trabajo ha ido deprisa porque todas las instituciones de la Unión Europea se han dedicado de lleno a conseguir que la Unión Europea se equipe con las más modernas defensas sobre el terreno. La presente Directiva se basa en textos comunitarios ya vigentes e incorpora al Derecho comunitario las 40 recomendaciones revisadas del Grupo de Acción Financiera Internacional sobre el blanqueo de capitales y la financiación del terrorismo.
La Directiva refuerza los controles en el sector financiero contra los que blanquean dinero y financian el terrorismo y estrecha la cooperación entre países. De ello no solo se beneficiará la lucha contra el blanqueo de capitales y la financiación del terrorismo, sino también la integridad y estabilidad del sector financiero. La UE está dando también un ejemplo que otros países del mundo pueden seguir e imitar.
La tercera Directiva relativa al blanqueo de capitales prohibirá el blanqueo de dinero y la financiación del terrorismo. Se aplicará al sector financiero, así como a abogados, notarios, contables, agentes inmobiliarios y casinos, proveedores de servicios a fideicomisos y empresas, así como proveedores de bienes cuando se efectúen pagos en efectivo superiores a 15 000 euros. En primer lugar, esos profesionales tendrán que identificar y verificar la identidad de su cliente y del beneficiario efectivo y vigilar las transacciones con el cliente, adoptando también un enfoque basado en el concepto de riesgo; en segundo lugar, tendrán que denunciar cualquier presunta operación de blanqueo de capitales o financiación del terrorismo al servicio de inteligencia financiera nacional; y, en tercer lugar, tendrán que adoptar medidas de apoyo como el mantenimiento de registros, la formación del personal y el establecimiento de políticas y procedimientos internos. La Directiva se complementa con una sección sobre la supervisión y ofrece la posibilidad de adoptar medidas de ejecución.
Con este sistema actualizado, hemos progresado enormemente. Quiero recalcar en particular los siguientes aspectos.
La cooperación entre el Parlamento Europeo, la Presidencia y la Comisión en torno a esta directiva ha sido muy constructiva. Eso demuestra no solo la voluntad de conseguir que se apruebe rápidamente en primera lectura, sino también la prioridad que damos todos nosotros a la lucha contra el blanqueo de capitales y la financiación del terrorismo.
Además, aprecio en especial el hecho de que todos hayamos demostrado un sincero deseo de llegar a un compromiso en torno a las principales cuestiones, como la declaración del beneficiario efectivo, la definición y aplicación de un deber de diligencia debida más estricto en el caso de personas políticamente expuestas, la cobertura de fideicomisos y abogados y, por último, pero sin ser por ello menos importante, la comitología.
Con respecto a la comitología, recuerdo que en la situación actual la Comisión está dispuesta a lo sumo a aceptar una cláusula de suspensión. Dicha cláusula contempla la suspensión del procedimiento de comitología cuatro años después de la entrada en vigor de la Directiva. En virtud del artículo 251 del Tratado, estas medidas pueden ser renovadas por el Parlamento y el Consejo a propuesta de la Comisión.

Monsieur le Président, la lutte contre le blanchiment de capitaux et le financement du terrorisme constitue une priorité politique de l’Union européenne. La Commission a adopté il y a moins d’un an ce projet de troisième directive sur la lutte contre le blanchiment de capitaux et le financement du terrorisme. Et aujourd’hui, elle est soumise à cette Assemblée. Cela prouve l’importance du texte.
Les travaux ont progressé rapidement parce que toutes les institutions de l’Union européenne se sont pleinement engagées à faire en sorte que l’Union européenne soit dotée des moyens de défense les plus modernes dans ce domaine. Cette directive s’appuie sur les textes communautaires existants et intègre au droit communautaire les quarante recommandations révisées du groupe d’action financière sur le blanchiment de capitaux et le financement du terrorisme.
La directive durcit les contrôles effectués dans le secteur financier à l’encontre des blanchisseurs de capitaux et renforce la coopération entre les pays. Ce texte profitera non seulement à la lutte contre le blanchiment de capitaux et le financement du terrorisme, mais aussi à l’intégrité et à la stabilité du secteur financier. L’UE offre également à d’autres pays dans le monde un exemple à suivre et à imiter.
La troisième directive sur le blanchiment de capitaux interdira le blanchiment de capitaux et le financement du terrorisme. Elle s’applique au secteur financier, ainsi qu’aux avocats, aux notaires, aux experts-comptables, aux agents immobiliers et aux casinos, aux prestataires de services aux sociétés et fiducies et aux fournisseurs de biens lorsque les paiements en espèces sont d’un montant supérieur à 15 000 euros. Ces personnes doivent: premièrement, établir et vérifier l’identité de leur client et de son détenteur bénéficiaire et superviser les transactions avec le client, tout en prenant en considération une approche fondée sur le risque; deuxièmement, faire état de leurs soupçons de blanchiment de capitaux et de financement du terrorisme à la cellule nationale de renseignement financier; et troisièmement, prendre des mesures de soutien comme la conservation de documents et pièces, la formation du personnel et la mise en place de politiques et procédures internes. La directive est complétée par une section consacrée à la surveillance et permet de prendre des mesures d’exécution.
Grâce à ce système actualisé, nous avons progressé énormément. Je tiens plus particulièrement à souligner les éléments suivants.
La coopération entre le Parlement européen, la présidence et la Commission à propos de cette directive a été très constructive, ce qui atteste non seulement de la volonté d’adopter rapidement le texte en première lecture, mais également de la priorité que nous accordons tous à la lutte contre le blanchiment de capitaux et le financement du terrorisme.
Par ailleurs, j’ai particulièrement apprécié le fait que nous ayons tous exprimé le désir sincère de trouver un compromis sur les principaux points, à savoir la définition du détenteur bénéficiaire, la définition des personnes politiquement exposées et l’application d’une vigilance accrue à leur égard, la couverture des fiducies et des avocats et, enfin et surtout, la comitologie.
Concernant la comitologie, je souligne que dans la situation actuelle, la Commission est tout au plus disposée à accepter une clause suspensive. Cette clause prévoit la suspension de la procédure de comitologie quatre ans après l’entrée en vigueur de la directive. Conformément à l’article 251 du Traité, ces mesures peuvent être renouvelées par le Parlement et le Conseil sur proposition de la Commission.

Ai soggetti menzionati viene chiesto, innanzi tutto, di identificare e verificare l’identità del proprio cliente e del suo beneficiario e di monitorare le transazioni con il cliente adottando un approccio basato sul rischio. Essi, inoltre, sono tenuti a segnalare casi sospetti di riciclaggio di denaro e di finanziamento del terrorismo all’unità nazionale di informazione finanziaria e ad adottare misure di sostegno, conservando le registrazioni, organizzando programmi di formazione del personale e mettendo a punto politiche e procedure interne. La direttiva è completata da una sezione sulla supervisione e offre la possibilità di adottare misure di attuazione.
Con questo sistema aggiornato abbiamo fatto enormi progressi. In particolare, vorrei attirare la vostra attenzione sui seguenti punti.

Mijnheer de Voorzitter, de strijd tegen het witwassen van geld en de financiering van terrorisme is een politieke prioriteit voor de Europese Unie. De Commissie heeft dit voorstel voor een derde richtlijn over de strijd tegen het witwassen van geld en de financiering van terrorisme minder dan een jaar geleden aangenomen! En vandaag ligt het voor in dit Parlement. Dit illustreert het grote belang van deze tekst.
Het werk is zo snel gegaan omdat alle instellingen van de Europese Unie zich volledig hebben ingezet om ervoor te zorgen dat de Europese Unie werd uitgerust met beveiliging van topklasse op dit terrein. Deze richtlijn bouwt voort op bestaande communautaire teksten en bevat de veertig herziene aanbevelingen van de financiële actiegroep ter bestrijding van het witwassen van geld en de financiering van terrorisme.
Deze richtlijn zorgt voor aangescherpte controlemechanismen in de financiële sector tegen witwassers van geld en financiers van terrorisme en versterkt de onderlinge samenwerking tussen landen. Niet alleen zal de strijd tegen het witwassen van geld en de financiering van terrorisme hiervan profiteren, ook de integriteit en stabiliteit van de financiële sector zal toenemen. Deze richtlijn is van toepassing op de financiële sector, maar ook op advocaten, notarissen, accountants, makelaars in onroerend goed, casino's, verrichters van trust- en bedrijfsdiensten en alle leveranciers van goederen bij contante betalingen ten bedrage van meer dan 15 000 euro. Deze mensen dienen ten eerste de identiteit van hun klanten en de begunstigde eigenaar vast te stellen en de transacties met de klant te controleren, waarbij moet worden uitgegaan van een risicogebaseerde benadering; ten tweede moeten vermoedens omtrent witwaspraktijken en financiering van terrorisme worden gemeld bij de nationale financiële inlichtingendienst; ten derde dienen ze ondersteunende maatregelen te nemen, zoals het bijhouden van gegevens, de opleiding van personeel en de totstandkoming van intern beleid en procedures op dit gebied. Deze richtlijn wordt gecompleteerd met een gedeelte over toezicht en biedt de mogelijkheid tot het nemen van tenuitvoerleggingsmaatregelen.
Met dit geactualiseerde systeem hebben we enorme vooruitgang geboekt. Ik zou met name de volgende elementen willen onderstrepen.
De samenwerking tussen het Europees Parlement, het voorzitterschap en de Commissie voor deze richtlijn is uitermate constructief geweest. Dit duidt niet alleen op de wil om de richtlijn zo snel mogelijk bij eerste lezing aan te nemen, maar ook op de prioriteit die wij allen geven aan de bestrijding van het witwassen van geld en van de financiering van terrorisme.
Verder heb ik grote waardering gehad voor het feit dat iedereen oprecht blijk heeft gegeven van de wens om over de belangrijkste zaken een compromis te bereiken, en met belangrijke zaken bedoel ik: de definitie van de begunstigde eigenaar, de definitie en toepassing van uitgebreide "ken-uw-cliënt"-procedures in verband met politieke of publieke personen, de opneming van trusts en advocaten, en, niet te vergeten, comitologie.
Inzake comitologie wil ik onderstrepen dat de Commissie in de huidige situatie optimaal bereid is een sunset-clausule te aanvaarden. Een dergelijke clausule voorziet in de schorsing van de comitologieprocedure vier jaar na de inwerkingtreding van de richtlijn. Overeenkomstig artikel 251 van het Verdrag kunnen deze maatregelen worden vernieuwd door het Parlement en de Raad naar aanleiding van een voorstel van de Commissie.

The third anti-money laundering directive will prohibit money laundering as well as terrorist financing. It is applicable to the financial sector as well as to lawyers, notaries, accountants, real estate agents and casinos, trust and company service providers as well as all providers of goods when payments are made in cash in excess of EUR 15 000. These people need, firstly, to identify and verify the identity of their customer and of its beneficial owner and to monitor transactions with the customer, while taking into account a risk-based approach; secondly, to report suspicions on money laundering and terrorist financing to the national financial intelligence unit; and, thirdly, to take supporting measures, such as record keeping, training of personnel and the establishment of internal policies and procedures. The directive is completed with a section on supervision and offers the possibility to take implementing measures.
With this updated system we have progressed enormously. I should like in particular to underline the following elements.
The cooperation between the European Parliament, the presidency and the Commission on this directive has been extremely constructive. This shows not only the willingness to have a fast-track adoption at first reading, but also the priority that all of us give to combating money laundering and fighting terrorist financing.
Furthermore, I especially appreciated the fact that we have all shown a sincere desire to achieve a compromise on the main issues, i.e. the definition of the beneficial owner, the definition of and the application of enhanced due diligence in respect of politically exposed persons, the coverage of trusts and lawyers and last, but not least, comitology.
In respect of comitology, I underline that in the actual situation the Commission as a maximum is willing to accept a sunset clause. This clause provides for the suspension of the comitology procedure four years after the entry into force of the directive. In accordance with Article 251 of the Treaty, these measures may be renewed by Parliament and the Council on a proposal from the Commission.

Hoje, a proposta está em debate nesta Assembleia. Isto é prova da importância deste texto.
Os trabalhos têm avançado rapidamente porque todas as Instituições da União Europeia se têm empenhado plenamente em assegurar que, neste domínio, a União esteja equipada com defesas baseadas na mais avançada tecnologia. Esta directiva vem reforçar textos comunitários existentes e incorpora no direito comunitário as 40 recomendações revistas do Grupo de Acção Financeira Internacional sobre branqueamento de capitais e financiamento do terrorismo.
A directiva reforça os controlos utilizados no sector financeiro contra os autores de branqueamento de capitais e financiadores do terrorismo, bem como a cooperação entre os países. Isto irá beneficiar não só a luta contra o branqueamento de capitais e o financiamento do terrorismo, mas também a integridade e estabilidade do sector financeiro. Além disso, a UE está a dar um exemplo que outros países do mundo podem seguir e igualar.
A terceira directiva relativa à luta contra o branqueamento de capitais proíbe o branqueamento de capitais e o financiamento do terrorismo. É aplicável ao sector financeiro, bem como a advogados, notários, contabilistas, agentes imobiliários e casinos, prestadores de serviços a fundos fiduciários e a sociedades, e ainda a todos os fornecedores de produtos sempre que sejam efectuados pagamentos em numerário envolvendo montantes superiores a 15 000 euros. Estas pessoas deverão, em primeiro lugar, identificar e verificar a identidade do seu cliente e do seu beneficiário efectivo, bem como controlar as transacções em conjunto com o cliente, tendo em conta uma abordagem baseada no risco; em segundo lugar, deverão comunicar suspeitas de branqueamento de capitais e financiamento do terrorismo à unidade nacional de informação financeira; e, em terceiro lugar, deverão adoptar medidas de apoio, como, por exemplo, manter registos, dar formação ao seu pessoal e estabelecer políticas e procedimentos internos. A directiva contém ainda uma secção sobre supervisão e prevê a possibilidade de serem adoptadas medidas de execução.
Este sistema actualizado representa um enorme progresso. Gostaria, em particular, de destacar os seguintes elementos.
O Parlamento Europeu, a Presidência e a Comissão mantiveram uma cooperação extremamente construtiva no que se refere a esta directiva. Isto demonstra não só o desejo de que a mesma seja adoptada em primeira leitura no âmbito do procedimento acelerado, mas também a prioridade que todos atribuímos à luta contra o branqueamento de capitais e o financiamento do terrorismo.
Por outro lado, apreciei especialmente o facto de todos termos mostrado o desejo sincero de chegar a um compromisso sobre as questões principais, designadamente a definição de beneficiário efectivo, a definição e aplicação de obrigações de fiscalização reforçadas relativamente a pessoas politicamente expostas, e, por último, mas não menos importante, a comitologia.
No que se refere à comitologia, quero frisar que, na realidade, a Comissão está disposta a aceitar, no máximo, uma cláusula de caducidade. Esta cláusula prevê a suspensão do procedimento de comitologia quatro anos após a entrada em vigor da directiva. Nos termos do artigo 251º do Tratado, estas medidas poderão ser renovadas pelo Parlamento e pelo Conselho com base numa proposta apresentada pela Comissão.

"Herr talman! Kampen mot penningtvätt och finansiering av terrorism är en politisk prioritering för Europeiska unionen. Kommissionen antog detta förslag till ett tredje direktiv om kampen mot penningtvätt och finansiering av terrorism för mindre än ett år sedan! I dag ligger det således framför oss i kammaren. Detta är ett bevis på textens betydelse.
Arbetet har framskridit snabbt eftersom alla institutioner i Europeiska unionen helhjärtat har inriktat sig på att säkerställa att Europeiska unionen är utrustad med det allra senaste försvar som finns på området. Direktivet grundar sig på en befintlig gemenskapstext och innebär att de 40 reviderade rekommendationerna om penningtvätt och finansiering av terrorism från arbetsgruppen mot penningtvätt införlivas i gemenskapsrätten.
Direktivet innebär en skärpning av kontrollerna i den finansiella sektorn mot personer som sysslar med penningtvätt och finansiärer av terrorism samt en förstärkning av samarbetet mellan länder. Det är inte bara kampen mot penningtvätt och finansiering av terrorism som kommer att gynnas av detta, utan det kommer också att främja den finansiella sektorns integritet och stabilitet. EU föregår också med gott exempel för andra länder i världen, som de sedan kan följa och anpassa sig till.
Det tredje direktivet mot penningtvätt kommer att förhindra penningtvätt, såväl som finansiering av terrorism. Det är tillämpligt för den finansiella sektorn, såväl som för jurister, notarier, revisorer, fastighetsmäklare och kasinon, förvaltare av truster och tjänsteleverantörer, såväl som alla varuleverantörer när betalningar sker kontant till ett belopp som överstiger 15 000 euro. Dessa personer måste först identifiera och verifiera sina kunders och huvudmannens identitet och övervaka transaktioner med kunden, samtidigt som de tar med en riskbaserad strategi i beräkningen. För det andra måste de rapportera misstankar om penningtvätt och finansiering av terrorism till de nationella finansunderrättelseenheterna. För det tredje måste de vidta stödåtgärder, såsom bevarande av uppgifter, personalutbildning och fastställande av interna riktlinjer och förfaranden. Direktivet avslutas med ett avsnitt om övervakning och ger möjlighet att vidta genomförandeåtgärder.
Vi har gjort enorma framsteg med detta uppdaterade system. Jag skulle särskilt vilja betona följande delar.
Samarbetet mellan Europaparlamentet, ordförandeskapet och kommissionen om detta direktiv har varit mycket konstruktivt. Detta visar inte bara på villigheten att få till stånd ett snabbt antagande i första behandlingen, utan också att vi alla prioriterar bekämpningen av penningtvätt och finansiering av terrorism.
Därutöver uppskattade jag särskilt den innerliga önskan vi alla har visat att uppnå en kompromiss i huvudfrågorna, dvs. definitionen av huvudman, definitionen och tillämpningen av högre krav på kundkännedom när det gäller förbindelser med personer i politiskt känslig ställning, bevakningen av truster och jurister och sist men inte minst, kommittéförfarandet.
När det gäller kommittéförfarandet vill jag betona att kommissionen i den aktuella situationen som längst kan sträcka sig till att godkänna en tidsfristklausul. Denna klausul gör det möjligt att upphäva kommittéförfarandet fyra år efter det att direktivet trätt i kraft. I enlighet med artikel 251 i fördraget kan parlamentet och rådet förnya dessa åtgärder efter förslag från kommissionen.
Jag skulle vilja tacka parlamentet på förhand för att det möjliggjort en förlikning vid första behandlingen, och jag vill särskilt varmt gratulera Hartmut Nassauer, Joseph Muscat och skuggföredragandena för kvaliteten på deras arbete, och tacka dem för den mycket konstruktiva attityd de har visat under utarbetandet av betänkandet."@sv21
