Mr President, I wish to thank the rapporteur, Mr Zappalà, for his draft recommendation, which usefully completes the Council common position in some aspects and fully supports the essential objectives of the Commission’s proposal. I also wish to thank the shadow rapporteurs, Mrs Weiler, Mrs Rühle and Mr Lambsdorff for their cooperation and constructive attitude in working towards an agreement with the Council on this vital piece of single market legislation.
As you all know, this directive is an important practical contribution to skills mobility. It covers a large variety of issues of great interest to the professions and also to their clients. A reasonable compromise on the text provides us with a major success story in the field of the internal market. The final result strikes a balance between the right to free movement of fully qualified professionals and the need to protect consumers.
In particular, I welcome the maintenance of the five levels of qualification, which have played a central role in the operation of professional recognition at EU level over the last 15 years. This solution ensures the transparency necessary for the application of the system and keeps existing guarantees for migrants.
The directive improves conditions of free movement for professionals through simpler and clearer rules, in particular for the temporary provision of cross-border services. I am happy to acknowledge that Parliament has played a constructive role in achieving the right degree of flexibility for the provider of a professional service who wishes to exercise his activity elsewhere in the Union.
In an enlarged Europe, more effective systems for managing our legislation have become an absolute necessity. The mechanisms and procedures provided for in the directive update the existing ones and should ensure its efficient implementation in the years to come. Ich möchte dem Berichterstatter, Herrn Zappalà, für seinen Empfehlungsentwurf danken, der den Gemeinsamen Standpunkt des Rates in Bezug auf einige Aspekte sinnvoll abrundet und die wesentlichen Ziele des Vorschlags der Kommission umfassend unterstützt. Ich danke auch Frau Weiler, Frau Rühle und Herrn Lambsdorff als Schattenberichterstatter für ihre Zusammenarbeit und konstruktive Haltung im Ringen um eine Einigung mit dem Rat über diesen entscheidenden Rechtsakt der Binnenmarktgesetzgebung.
Wie Sie alle wissen, stellt diese Richtlinie einen wichtigen praktischen Beitrag zur Mobilität von Fachkräften dar. Sie umfasst eine Vielzahl von Problemen, die für die Berufsangehörigen wie für deren Kunden von großem Interesse sind. Ein vernünftiger Kompromiss bei diesem Text sorgt im Bereich der Binnenmarktgesetzgebung für einen großen Erfolg. In seiner endgültigen Fassung sorgt dieses Dokument für ein ausgewogenes Verhältnis zwischen dem Recht von Berufstätigen mit einer abgeschlossenen Ausbildung auf Freizügigkeit und der Notwendigkeit des Verbraucherschutzes.
Ich begrüße insbesondere die Beibehaltung der fünf Berufsqualifikationsniveaus, die in den letzten 15 Jahren bei der Anerkennung von Berufsqualifikationen in der EU eine zentrale Rolle gespielt haben. Diese Lösung gewährleistet die für die Anwendung des Systems erforderliche Transparenz und sichert die für Migranten existierenden Garantien.
Die Richtlinie verbessert dank einfacherer und klarerer Vorschriften die Bedingungen für die Freizügigkeit von Berufsangehörigen, und zwar insbesondere im Hinblick auf die zeitweilige Erbringung von grenzüberschreitenden Dienstleistungen. Ich freue mich bestätigen zu können, dass das Parlament einen konstruktiven Beitrag zur Erzielung des richtigen Maßes an Flexibilität für den Erbringer einer qualifizierten Leistung geleistet hat, der seine Tätigkeit in einem anderen Land der Union ausüben möchte.
In einem erweiterten Europa sind wirksamere Systeme für die Handhabung unserer Gesetzgebung eine absolute Notwendigkeit. Die in der Richtlinie vorgesehenen Mechanismen und Verfahren aktualisieren die derzeit bestehenden Systeme und dürften die effiziente Umsetzung der Richtlinie in den nächsten Jahren garantieren. Vor allem die neue Regelung zur automatischen Anerkennung medizinischer Fachrichtungen trägt sowohl dem Erfordernis der Vereinfachung als auch den legitimen Erfordernissen des Berufs Rechnung. Durch Beratung mit den Berufsverbänden verschafft sich die Kommission die Fachkenntnisse, die für die ordnungsgemäße Handhabung des Systems unerlässlich sind. Der diesbezügliche Vorschlag, den Toine Manders auf der Trilogsitzung letzte Woche unterbreitet hat, war besonders zu begrüßen. Er ermöglicht uns eine ordnungsgemäße und effektive Konsultation von Berufsverbänden und die Einarbeitung der Ergebnisse dieser Konsultationen in Entscheidungen, die im Komitologieverfahren zu treffen sind. Die Berufsverbände sind daher eng in die Umsetzung dieser Richtlinie einbezogen.
Und schließlich möchte ich feststellen, dass ich die vom Parlament vorgeschlagenen Zusätze zum Gemeinsamen Standpunkt begrüße, wie z. B. erstens die Möglichkeit der Einführung von Berufsausweisen durch Berufsorganisationen; zweitens die Möglichkeit der Harmonisierung bei weiteren Berufen und drittens die Bestimmung, die dem Missbrauch und damit dem Qualifikationswettlauf nach unten den Riegel vorschiebt.
Abschließend möchte ich den Mitgliedern des Ausschusses für Binnenmarkt und Verbraucherschutz meine Anerkennung aussprechen für ihr konstruktives Herangehen, das eine Einigung mit dem Rat ohne Vermittlungsverfahren ermöglicht hat."@de9

Χαιρετίζω ειδικότερα τη διατήρηση των πέντε επιπέδων επαγγελματικών προσόντων, τα οποία διαδραμάτισαν κεντρικό ρόλο στη διαδικασία αναγνώρισης επαγγελματικών προσόντων σε κοινοτικό επίπεδο τα τελευταία 15 χρόνια. Η λύση αυτή διασφαλίζει την απαραίτητη διαφάνεια για την εφαρμογή του συστήματος και διατηρεί τις υφιστάμενες εγγυήσεις για τους μετανάστες.
Η οδηγία βελτιώνει τις συνθήκες ελεύθερης κυκλοφορίας για τους επαγγελματίες μέσω απλούστερων και σαφέστερων κανόνων, ειδικά για την προσωρινή παροχή διασυνοριακών υπηρεσιών. Señor Presidente, doy las gracias al ponente, el señor Zappalà, por su propuesta de recomendación, la cual viene a completar de manera útil algunos aspectos de la posición común del Consejo, al tiempo que respalda plenamente los objetivos principales de la propuesta de la Comisión. Asimismo, doy las gracias a los ponentes alternativos, la señora Weiler, la señora Rühle y el señor Lambsdorff, por su cooperación y por la actitud constructiva mantenida con vistas a alcanzar un acuerdo con el Consejo en relación con esta pieza clave de la legislación del mercado único.
Como todos ustedes saben, esta directiva representa una importante contribución práctica a la movilidad de profesionales. Abarca a una amplia variedad de asuntos de gran interés para los profesionales y sus clientes. El establecimiento de un compromiso razonable en torno a este texto constituye un éxito ejemplar en materia de mercado interior, cuyo resultado final determina un equilibrio entre el derecho a la libre circulación de los profesionales cualificados y la necesidad de garantizar la protección de los consumidores.

En este sentido, la sugerencia realizada por Toine Manders durante el diálogo a tres bandas de la semana pasada ha sido acogida con especial agrado, ya que nos permite garantizar una consulta efectiva y provechosa de las organizaciones profesionales e incorporar los resultados de la misma a las decisiones que se vayan a adoptar a través de la comitología. Por consiguiente, la participación de las asociaciones profesionales en la aplicación de la directiva será muy intensa.
Finalmente, aprecio las aportaciones a la posición común sugeridas por el Parlamento, como las referentes a las siguientes cuestiones: en primer lugar, la posibilidad de que las asociaciones profesionales emitan certificados profesionales; en segundo lugar, la posibilidad de armonizar un número mayor de profesiones en el futuro y, en tercer lugar, la cláusula destinada a evitar los abusos de la denominada «compra de cualificaciones».

Arvoisa puhemies, haluan kiittää esittelijä Zappalàa hänen suositusluonnoksestaan, joka täydentää joiltakin osin hyödyllisellä tavalla neuvoston yhteistä kantaa ja jossa tuetaan täysimääräisesti komission ehdotuksen olennaisia tavoitteita. In het bijzonder juich ik toe dat de vijf kwalificatieniveaus, die de afgelopen vijftien jaar een centrale rol hebben gespeeld bij de beroepserkenning in EU-verband, zijn gehandhaafd. Hierdoor wordt de transparantie gewaarborgd die nodig is voor de toepassing van het stelsel, en blijven de bestaande garanties voor migranten intact.
In de richtlijn worden de voorwaarden voor het vrije verkeer van beroepsbeoefenaren via eenvoudigere en duidelijkere regels verbeterd, vooral als het gaat om de tijdelijke verlening van grensoverschrijdende diensten. Ik ben blij dat ik kan zeggen dat het Parlement een constructieve rol heeft gespeeld waardoor de verlener van een professionele dienst die zijn activiteit elders in de Unie wil verrichten, nu over de juiste mate van flexibiliteit beschikt.
In een uitgebreid Europa is het een absolute noodzaak dat de systemen voor het beheer van onze wetgeving doeltreffender worden. De in de richtlijn genoemde mechanismen en procedures vervangen de bestaande mechanismen en procedures en dienen in de komende jaren te zorgen voor een efficiënte uitvoering ervan. Met name wordt in de nieuwe regeling voor de automatische erkenning van medische specialismen de noodzaak van vereenvoudiging met de legitieme eisen van de beroepsgroep verzoend. Dankzij het overleg met beroepsverenigingen krijgt de Commissie het technische advies dat nodig is om het systeem goed te laten werken. Wat dit betreft was de suggestie van Toine Manders tijdens de trialoog afgelopen week bijzonder welkom. Die suggestie biedt een handvat voor een adequaat en doeltreffend overleg met beroepsorganisaties en de resultaten van dat overleg kunnen worden meegenomen in de besluitvorming die via comitologie moet geschieden. Op deze wijze zullen beroepsverenigingen nauw bij de uitvoering van de richtlijn worden betrokken.

Um compromisso razoável sobre o texto é, para nós, um sucesso de monta no âmbito do mercado interno. O resultado final consegue um equilíbrio entre o direito à livre circulação de profissionais plenamente qualificados e a necessidade de proteger os consumidores.
Acolho com particular satisfação a manutenção dos cinco níveis de qualificação, que desempenharam um papel fundamental no reconhecimento profissional a nível da UE nos últimos 15 anos. Esta solução garante a transparência necessária para aplicar o sistema e mantém as garantias de que os emigrantes já beneficiam.
A directiva melhora as condições da livre circulação de profissionais através de regras mais simples e claras, em particular no que diz respeito à prestação temporária de serviços além-fronteiras. É com satisfação que verifico que o Parlamento teve uma acção construtiva para se atingir o grau de flexibilidade adequado para quem presta um serviço a nível profissional e pretende exercer a sua actividade em qualquer local da União.
Numa Europa alargada, tornaram-se absolutamente imprescindíveis sistemas de gestão da nossa legislação mais eficazes. Os mecanismos e procedimentos estabelecidos pela directiva actualizam os já existentes e deviam garantir a sua eficaz execução nos próximos anos. Em especial, o novo regime de reconhecimento automático das especializações médicas reconcilia a necessidade de simplificação com as legítimas exigências da profissão. Por seu lado, a consulta das associações profissionais providenciará à Comissão o aconselhamento técnico necessário para uma gestão adequada do sistema. Neste aspecto, a sugestão do deputado Toine Manders no trílogo da semana passada foi especialmente bem acolhida. Permite-nos assegurar a consulta, adequada e eficaz, das organizações profissionais e aproveitar os resultados dessa consulta para as decisões a tomar através da comitologia. Assim, as associações profissionais estarão estreitamente associadas à execução da directiva.
Por fim, mas não menos importante, acolho com satisfação os aditamentos à posição comum sugeridos pelo Parlamento, como é o caso dos que se referem: primeiro, à possibilidade de as associações profissionais emitirem carteiras profissionais; depois, à possibilidade de harmonizar ainda mais, de futuro, outras profissões; e, em terceiro lugar, à cláusula anti-abuso, que impedirá a chamada “caça às qualificações”.
Terminarei prestando homenagem aos membros da Comissão do Mercado Interno e da Protecção dos Consumidores pela sua abordagem construtiva, que permitiu o acordo com o Conselho sem a necessidade de conciliação."@pt17

I also wish to thank the shadow rapporteurs, Mrs Weiler, Mrs Rühle and Mr Lambsdorff for their cooperation and constructive attitude in working towards an agreement with the Council on this vital piece of single market legislation.
As you all know, this directive is an important practical contribution to skills mobility. It covers a large variety of issues of great interest to the professions and also to their clients. A reasonable compromise on the text provides us with a major success story in the field of the internal market. The final result strikes a balance between the right to free movement of fully qualified professionals and the need to protect consumers.
In particular, I welcome the maintenance of the five levels of qualification, which have played a central role in the operation of professional recognition at EU level over the last 15 years. This solution ensures the transparency necessary for the application of the system and keeps existing guarantees for migrants.
The directive improves conditions of free movement for professionals through simpler and clearer rules, in particular for the temporary provision of cross-border services. I am happy to acknowledge that Parliament has played a constructive role in achieving the right degree of flexibility for the provider of a professional service who wishes to exercise his activity elsewhere in the Union.
In an enlarged Europe, more effective systems for managing our legislation have become an absolute necessity. The mechanisms and procedures provided for in the directive update the existing ones and should ensure its efficient implementation in the years to come. In particular, the new regime for the automatic recognition of medical specialities reconciles the need for simplification with the legitimate demands of the profession. For its part, the consultation of professional associations will provide the Commission with the technical advice necessary for the proper running of the system. Toine Manders’ suggestion, in this respect, at last week’s trialogue was particularly welcome. It enables us to ensure a proper and effective consultation of professional organisations and feed in the results of that consultation in the decisions to be taken through comitology. Professional associations will thus be closely involved in the implementation of the directive.
Last, but not least, I appreciate the additions to the common position suggested by Parliament, such as those regarding: firstly, the possibility for professional associations to create professional cards; secondly, the possibility of further harmonisation for additional professions in the future; and, thirdly, the anti-abuse clause which will preclude so-called ‘qualifications shopping’.

Herr talman! Jag vill tacka föredraganden, Stefano Zappalà, för hans förslag till rekommendation, vilket med fördel kompletterar rådets gemensamma ståndpunkt inom vissa aspekter och till fullo stöder huvudmålsättningarna i kommissionens förslag. Jag vill också tacka skuggföredragandena, Barbara Weiler, Heide Rühle och Alexander Lambsdorff, för deras samarbete och konstruktiva inställning till arbetet mot ett avtal med rådet i denna viktiga lagstiftning om den inre marknaden.
Som ni alla vet innebär detta direktiv ett viktigt praktiskt bidrag till rörligheten för kvalificerade yrkesutövare. Det omfattar ett brett spektrum av frågor av stort intresse för yrkeskårerna och även för deras kunder. En rimlig kompromiss om texten ger oss en viktig historia om framgång inom den inre marknadens område. Slutresultatet blir en balans mellan rätten till fri rörlighet för fullt kvalificerade yrkesutövare och behovet att skydda konsumenterna.
Jag välkomnar särskilt att de fem kvalificeringsnivåerna behålls, vilka har spelat en central roll i erkännandet av yrkeskvalifikationer på EU-nivå under de senaste 15 åren. Denna lösning ger den öppenhet som behövs för att använda systemet och leder till att de befintliga garantierna för invandrare bibehålls.
Genom direktivet förbättras villkoren för den fria rörligheten för yrkesutövare genom enklare och tydligare regler, särskilt för ett tillfälligt erbjudande av gränsöverskridande tjänster. Jag är glad över att kunna bekräfta att parlamentet har spelat en konstruktiv roll i uppnåendet av rätt grad av flexibilitet för den som utför en professionell tjänst och som vill utöva sin verksamhet någon annanstans i unionen.
I ett utvidgat EU har effektivare system för hanteringen av vår lagstiftning blivit en absolut nödvändighet. De mekanismer och förfaranden som föreskrivs i direktivet innebär att de befintliga uppdateras, vilket bör säkerställa att de genomförs på ett effektivt sätt under de kommande åren. Särskilt förenar det nya systemet för automatiskt erkännande av medicinska specialiteter behovet av en förenkling med de välgrundade kraven inom yrket. Samrådet med branschföreningar kommer å sin sida att ge kommissionen de tekniska råd som behövs för att systemet skall fungera på rätt sätt. Toine Manders förslag i detta avseende i förra veckans trialog var särskilt välkommet. Det gör att vi kan säkerställa ett korrekt och effektivt samråd med branschorganisationer och föra in resultaten från detta samråd i de beslut som skall fattas genom kommittéförfarandet. Branschföreningar kommer därför att vara djupt involverade i direktivets införlivande.
Sist men inte minst uppskattar jag de tillägg till den gemensamma ståndpunkten som har föreslagits av parlamentet, särskilt dem som rör för det första möjligheten för branschföreningar att skapa yrkeskort, för det andra möjligheten till ytterligare harmonisering för fler yrken i framtiden och för det tredje den klausul mot missbruk som kommer att förhindra så kallad kvalifikationsshopping.
Som avslutning vill jag ge ett erkännande till ledamöterna i utskottet för den inre marknaden och konsumentskydd för deras konstruktiva infallsvinkel som har möjliggjort ett avtal med rådet utan behov av förlikning."@sv21
