Mr President, on 16 March 2004 the Commission adopted a proposal for a Council and Parliament recommendation on the protection of film heritage and the competitiveness of related industrial activities.
Cinematography is an art form contained on a fragile medium, which therefore requires positive, quick and effective action from the public authorities to ensure its preservation. Films bear comprehensive witness to our times. The protection of the European film heritage, including co-productions with third countries, is therefore in the interest of future generations. In order to ensure that the European film heritage is passed down to future generations, it has to be systematically collected, catalogued, preserved and restored. It should also be made accessible for educational, cultural, research or other non-commercial use; in all cases, in compliance with copyright and related rights. It is therefore the Commission’s intention to promote European standards on the cataloguing of films and we have therefore given a mandate to the European Committee for Standardisation to go ahead with preparatory work. That will facilitate the exchange of information and the interoperability of the databases that are kept by the film archives in all Member States. The Commission will also promote cooperation between film archives. One advantage of this cooperation will be the possibility of recuperating and restoring so-called ‘lost films’.
The report and the amendments discussed today reflect the thorough work by the rapporteur and shadow rapporteurs on the one hand, and the presidency on the other. I would like to thank Mr Hegyi for his very constructive work in that respect. The Commission is grateful to all the key players who made it possible to reach a good compromise today.
The Commission proposal, as amended by Parliament, recommends that Member States introduce an obligation to deposit cinematographic works that form part of a Member State’s audiovisual heritage and that have received public funding. Also, and in compliance with the principle of subsidiarity, the text gives Member States the option as to how to implement this obligation, by law or by means of contract: we leave that up to Member States.
A recommendation is the best-adapted instrument available for achieving the objectives of the proposed measures. They are: first, strengthening of the film industry by laying the foundations for the explanation of sleeping catalogues by rights holders; and secondly, the systematic deposit, collection and conservation of Member States’ visual heritages. The Commission is very satisfied –– and I think the citizens are, too – with the prospect of a first reading agreement. The Commission accepts Parliament’s amendments insofar as they correspond to the political agreement reached between Parliament and the presidency and confirmed by Coreper on 2 May 2005."@en4

"Hr. formand, den 16. marts 2004 vedtog Kommissionen et forslag til Rådets og Parlamentets henstilling om filmarv og konkurrenceevnen for relaterede industrielle aktiviteter.
Film er en kunstart på et skrøbeligt medie, som derfor kræver, at de offentlige myndigheder griber positivt, hurtigt og effektivt ind for at sikre dens bevaring. Film er vidnesbyrd om vores tid. Beskyttelsen af den europæiske filmarv, herunder også fællesproduktioner med tredjelande, er derfor af interesse for fremtidens generationer. For at sikre, at den europæiske filmarv videregives til kommende generationer, skal den systematisk indsamles, katalogiseres, bevares og moderniseres. Den skal derfor også kunne bruges til uddannelsesmæssige, kulturelle, forskningsmæssige eller andre ikke-kommercielle formål; under alle omstændigheder med respekt for ophavsret og dertil hørende rettigheder. Derfor har Kommissionen til hensigt at fremme europæiske standarder for katalogisering af film, og vi har derfor givet Den Europæiske Standardiseringsorganisation mandat til at gå i gang med det indledende arbejde. Herr Präsident! Am 16. März 2004 nahm die Kommission einen Vorschlag für eine Empfehlung des Rates und des Parlaments zum Schutz des Filmerbes und zur Wettbewerbsfähigkeit der einschlägigen Industriezweige an.
Kinofilme sind eine Kunstform und werden auf ein sehr fragiles Medium gebannt. Um sie zu erhalten, ist vonseiten des Staates positives, schnelles und effizientes Handeln gefragt. Filme sind wertvolle Zeitzeugen. Der Schutz des europäischen Filmerbes, einschließlich der Koproduktionen mit Drittstaaten, liegt daher im Interesse der Generationen, die nach uns kommen. Damit das europäische Filmerbe den zukünftigen Generationen erhalten bleibt, muss es systematisch erfasst, katalogisiert, bewahrt und restauriert werden. Dieses Erbe sollte – bei steter Wahrung des Urheberrechts und der verwandten Schutzrechte – der Bildung, Kultur oder Forschung und anderen nicht erwerbswirtschaftlichen Bereichen zugänglich gemacht werden. Die Kommission beabsichtigt daher, die europaweite Standardisierung von Filmkatalogen zu fördern, und wir haben deshalb dem Europäischen Komitee für Normung das Mandat erteilt, mit den entsprechenden Vorbereitungen zu beginnen. Das wird den Informationsaustausch und die Interoperabilität der Datenbanken der Filmarchive aller Mitgliedstaaten verbessern. Die Kommission wird zudem die Kooperation zwischen einzelnen Filmarchiven fördern. Ein Vorteil dieser Zusammenarbeit wird die Möglichkeit sein, so genannte verschollene Filme zu retten und zu restaurieren.
Der Bericht und die heute diskutierten Änderungsanträge spiegeln die gründliche Arbeit des Berichterstatters und der Schattenberichterstatter sowie der Ratspräsidentschaft wider. Ich möchte Herrn Hegyi für seine sehr konstruktive Arbeit danken. Die Kommission dankt ebenso allen, die zum heutigen positiven Kompromiss entscheidend beigetragen haben.
Der Vorschlag der Kommission in seiner durch das Parlament abgeänderten Form empfiehlt den Mitgliedstaaten, die Pflichthinterlegung für solche Kinofilme einzuführen, die zum audiovisuellen Erbe eines Mitgliedstaates gehören und mit staatlichen Mitteln unterstützt wurden. Des Weiteren bietet der Text den Mitgliedstaaten im Einklang mit dem Subsidiaritätsprinzip zwei Möglichkeiten für die Umsetzung dieser Pflicht - ob gesetzlich oder vertraglich ist den einzelnen Mitgliedstaaten überlassen.
Eine Empfehlung ist für die Erlangung der Ziele der vorgeschlagenen Maßnahmen am besten geeignet. Diese Ziele sind: erstens Stärkung der Filmindustrie, indem man die Inhaber von Urheberrechten darum bittet, ruhende Kataloge zu erläutern; und zweitens die systematische Hinterlegung, Katalogisierung und Bewahrung des visuellen Erbes der Mitgliedstaaten. Die Kommission ist darüber, dass sich eine Einigung in erster Lesung abzeichnet, sehr zufrieden – und die Bürger sind es sicherlich auch. Die Kommission akzeptiert die Änderungsanträge des Parlaments, da sie der politischen Einigung zwischen Parlament und Ratspräsidentschaft entsprechen, die der Ausschuss der Ständigen Vertreter am 2. "Κύριε Πρόεδρε, στις 16 Μαρτίου 2004 η Επιτροπή ενέκρινε πρόταση σύστασης του Συμβουλίου και του Ευρωπαϊκού Κοινοβουλίου για την προστασία της κινηματογραφικής κληρονομιάς και την ανταγωνιστικότητα των συναφών βιομηχανικών δραστηριοτήτων.
Ο κινηματογράφος είναι μια μορφή τέχνης που αποτυπώνεται σε ένα εύθραυστο μέσο, το οποίο συνεπώς απαιτεί θετική, γρήγορη και αποτελεσματική δράση από τις δημόσιες αρχές για να διασφαλιστεί η διατήρησή του. Τα κινηματογραφικά έργα είναι μάρτυρες των καιρών μας. Η προστασία της ευρωπαϊκής κινηματογραφικής κληρονομιάς, συμπεριλαμβανομένων των συμπαραγωγών με τρίτες χώρες είναι συνεπώς προς το συμφέρον των επόμενων γενεών. Για να εξασφαλιστεί ότι η ευρωπαϊκή κινηματογραφική κληρονομιά θα κληροδοτηθεί στις μέλλουσες γενιές πρέπει να συλλεχθεί συστηματικά, να καταλογογραφηθεί, να συντηρηθεί και να αποκατασταθεί. Πρέπει επίσης να γίνει προσπελάσιμη για εκπαιδευτική, πολιτιστική, ερευνητική ή άλλη παρεμφερή μη εμπορική χρήση, σε συμμόρφωση πάντα με τα δικαιώματα πνευματικής ιδιοκτησίας και τα συγγενικά δικαιώματα. Είναι λοιπόν πρόθεση της Επιτροπής να προωθήσει την ευρωπαϊκή τυποποίηση στην καταλογογράφηση των ταινιών και έχουμε δώσει για αυτό το σκοπό εντολή στην Ευρωπαϊκή Επιτροπή Τυποποίησης να προχωρήσει στις προπαρασκευαστικές εργασίες. Αυτό θα διευκολύνει την ανταλλαγή πληροφοριών και τη διαλειτουργικότητα των βάσεων δεδομένων που τηρούνται από τα κινηματογραφικά αρχεία σε όλα τα κράτη μέλη. Η Επιτροπή θα προωθήσει επίσης τη συνεργασία μεταξύ των κινηματογραφικών αρχείων. Η πρόταση της Επιτροπής, όπως τροποποιήθηκε από το Κοινοβούλιο, συνιστά να θεσπίσουν τα κράτη μέλη την υποχρέωση κατάθεσης των κινηματογραφικών έργων που αποτελούν μέρος της οπτικοακουστικής κληρονομιάς ενός κράτους μέλους και έχουν χρηματοδοτηθεί από το δημόσιο. Επίσης, και σε εφαρμογή της αρχής της επικουρικότητας, το κείμενο αφήνει τα κράτη μέλη να επιλέξουν πώς θα εφαρμόσουν αυτή την υποχρέωση, δια νόμου ή συμβατικά: αυτό το αφήνουμε στα κράτη μέλη.
Μια σύσταση είναι η καταλληλότερη νομική πράξη που διαθέτουμε για την επίτευξη των στόχων των προταθέντων μέτρων. Αυτοί είναι: πρώτον, ενίσχυση της κινηματογραφικής βιομηχανίας με το να τεθούν τα θεμέλια για την αιτιολόγηση των ανεκμετάλλευτων καταλόγων από τους δικαιούχους και δεύτερον, η συστηματική συλλογή, συγκέντρωση και διατήρηση της οπτικής κληρονομιάς των κρατών μελών. Η Επιτροπή είναι πολύ ευχαριστημένη –και πιστεύω ότι και οι πολίτες είναι επίσης– με την προοπτική μιας συμφωνίας κατά την πρώτη ανάγνωση. Señor Presidente, el 16 de marzo de 2004 la Comisión adoptó una propuesta de recomendación del Consejo y del Parlamento sobre la protección del patrimonio cinematográfico y la competitividad de las actividades industriales relacionadas.
La cinematografía es una forma de arte contenida en un medio frágil, que por consiguiente requiere medidas positivas, rápidas y eficaces por parte de las autoridades públicas para garantizar su conservación. Las películas son un amplio testimonio de nuestros tiempos. Por consiguiente, la protección del patrimonio cinematográfico europeo, incluidas las coproducciones con terceros países, responde al interés de las generaciones futuras. Con el fin de garantizar que el patrimonio cinematográfico europeo se transmita a las generaciones futuras, hay que recopilarlo, catalogarlo, conservarlo y restaurarlo de modo sistemático. También debería ser accesible para fines educativos, culturales, de investigación u otros fines no comerciales, siempre dentro del respeto de los derechos de autor y otros derechos afines. Por ello, la Comisión pretende promover normas europeas sobre la catalogación de películas, y por lo tanto hemos emitido un mandato al Comité Europeo de Normalización para que siga adelante con los trabajos preparatorios. Arvoisa puhemies, komissio hyväksyi 16. maaliskuuta 2004 ehdotuksen neuvoston ja parlamentin suositukseksi elokuvaperinnöstä ja siihen liittyvän teollisen toiminnan kilpailukyvystä.
Elokuva on turmeltuvassa tallennusmuodossa esitettävä taiteen laji, minkä vuoksi tarvitaan viranomaisten myönteisiä, nopeita ja tehokkaita toimia sen säilyttämiseksi. Elokuvat muodostavat kattavan todistusaineiston ajastamme. Eurooppalaisen elokuvaperinnön suojeleminen, yhteistuotannot kolmansien maiden kanssa mukaan luettuina, on tulevien sukupolvien etujen mukaista. Jotta varmistetaan Euroopan elokuvaperinnön välittyminen tuleville sukupolville, se on järjestelmällisesti kerättävä, luetteloitava, säilytettävä ja restauroitava. Elokuvaperintöä olisi voitava käyttää opetus-, tutkimus- ja kulttuuritarkoituksiin ja muihin ei-kaupallisiin tarkoituksiin siten, että tekijänoikeudet ja lähioikeudet otetaan aina huomioon. Le cinéma est un art contenu sur un support fragile, qui requiert une action positive, rapide et efficace des autorités publiques pour garantir sa préservation. Les films témoignent en détail de notre époque. Il est donc dans l’intérêt des générations futures de protéger le patrimoine cinématographique européen, y compris les coproductions avec des pays tiers. Per tramandare loro il patrimonio cinematografico europeo è necessaria un’opera sistematica di raccolta, catalogazione, salvaguardia e restauro; esso inoltre dev’essere messo a disposizione per fini educativi, culturali, di ricerca o per altri usi analoghi non commerciali. Mijnheer de Voorzitter, op 16 maart 2004 heeft de Commissie een voorstel voor een aanbeveling van de Raad en het Parlement aangenomen over de bescherming van cinematografisch erfgoed en het concurrentievermogen van verwante industriële activiteiten.
Cinematografie is een kunstvorm die wordt vastgelegd op een kwetsbaar medium, en het behoud daarvan vergt derhalve positieve, snelle en effectieve actie van de kant van de publieke autoriteiten. Films zijn de alomvattende getuigen van onze tijden. De bescherming van het Europese cinematografisch erfgoed, inclusief coproducties met derde landen, is daarom in het belang van de toekomstige generaties. Om te garanderen dat het Europese cinematografisch erfgoed wordt overgeleverd aan de toekomstige generaties, dient het systematisch te worden verzameld, gecatalogiseerd, bewaard en gerestaureerd. Het dient ook toegankelijk te worden gemaakt voor het gebruik in onderwijs, onderzoek en cultuur en andere niet-commerciële doelen; dit gebruik dient in ieder geval in overeenstemming te zijn met het auteursrecht en naburige rechten. De Commissie is daarom voornemens de totstandkoming van Europese normen inzake de catalogisering van films te stimuleren en met dit oogmerk hebben wij het Europees Comité voor standaardisering gemachtigd om de voorbereidende werkzaamheden te starten. Dit zal de uitwisseling van informatie en de interoperabiliteit bevorderen tussen de databases die in de filmarchieven in alle lidstaten worden aangehouden. Para garantir que o património cinematográfico europeu é transmitido às gerações futuras, esse património tem de ser sistematicamente recolhido, catalogado, conservado e restaurado. Devia, também, ser tornado acessível para fins educacionais, culturais, de investigação ou outras utilizações não comerciais mas, sempre, respeitando os direitos de autor e direitos conexos. Assim, é intenção da Comissão promover normas europeias para a catalogação de filmes, pelo que mandatámos o Comité Europeu de Normalização para avançar com o trabalho preparatório. That will facilitate the exchange of information and the interoperability of the databases that are kept by the film archives in all Member States. The Commission will also promote cooperation between film archives. One advantage of this cooperation will be the possibility of recuperating and restoring so-called ‘lost films’.
The report and the amendments discussed today reflect the thorough work by the rapporteur and shadow rapporteurs on the one hand, and the presidency on the other. I would like to thank Mr Hegyi for his very constructive work in that respect. The Commission is grateful to all the key players who made it possible to reach a good compromise today.
The Commission proposal, as amended by Parliament, recommends that Member States introduce an obligation to deposit cinematographic works that form part of a Member State’s audiovisual heritage and that have received public funding. Also, and in compliance with the principle of subsidiarity, the text gives Member States the option as to how to implement this obligation, by law or by means of contract: we leave that up to Member States.
A recommendation is the best-adapted instrument available for achieving the objectives of the proposed measures. They are: first, strengthening of the film industry by laying the foundations for the explanation of sleeping catalogues by rights holders; and secondly, the systematic deposit, collection and conservation of Member States’ visual heritages. The Commission is very satisfied –– and I think the citizens are, too – with the prospect of a first reading agreement. The Commission accepts Parliament’s amendments insofar as they correspond to the political agreement reached between Parliament and the presidency and confirmed by Coreper on 2 May 2005."@sl19

Herr talman! Den 16 mars 2004 antog kommissionen ett förslag till rådets och Europaparlamentets rekommendation om skydd för filmarvet och konkurrenskraften i därtill kopplade branscher.
Filmen är en konstform som utnyttjar ett bräckligt medium och som därför kräver positiva, snabba och effektiva insatser från myndigheterna för att garantera att den bevaras. Filmerna bär omfattande vittnesbörd om vår tid. Skyddet för det europeiska filmarvet, inbegripet samproduktioner med tredjeländer, ligger därför i de framtida generationernas intresse. För att garantera att det europeiska filmarvet förs vidare till framtida generationer måste det systematiskt samlas in, katalogiseras, bevaras och restaureras. Det bör också göras tillgängligt för användning inom utbildning, kultur, forskning och andra icke-kommersiella områden, i samtliga fall i enlighet med bestämmelserna om upphovsrätt och närstående rättigheter. Därför har kommissionen för avsikt att främja EU-standarder för katalogisering av filmer, och vi har följaktligen givit Europeiska standardiseringskommittén i uppdrag att sätta i gång med förberedelsearbetet. Detta kommer att underlätta utbytet av information och förbättra driftskompatibiliteten mellan de databaser som filmarkiven i alla medlemsstater har. Kommissionen kommer också att främja samarbetet mellan filmarkiven. En fördel med detta samarbete kommer att vara möjligheten att restaurera och återställa så kallade ”förlorade filmer”.
Det betänkande och de ändringsförslag som diskuteras i dag återspeglar det grundliga arbete som har utförts dels av föredraganden och skuggföredragandena, dels av ordförandeskapet. Jag vill tacka Gyula Hegyi för hans mycket konstruktiva arbete i detta avseende. Kommissionen är tacksam mot alla de nyckelaktörer som har gjort det möjligt att komma fram till en bra kompromiss i dag.
I kommissionens förslag, med de ändringar som har gjorts av parlamentet, rekommenderas medlemsstaterna att införa en skyldighet att deponera filmer som ingår i en medlemsstats audiovisuella arv och som har fått offentliga bidrag. I överensstämmelse med subsidiaritetsprincipen ger texten också medlemsstaterna valfrihet att välja hur de skall fullgöra denna skyldighet, genom lag eller genom avtal. Detta låter vi medlemsstaterna avgöra.
En rekommendation är det bäst lämpade till buds stående instrumentet för att nå målen för de föreslagna åtgärderna. Dessa mål är för det första att stärka filmindustrin genom att skapa förutsättningar för rättsinnehavarna att utnyttja vilande kataloger och för det andra systematisk deponering, insamling och konservering av medlemsstaternas visuella arv. Kommissionen är mycket nöjd med utsikterna till en överenskommelse vid första behandlingen – och det tror jag att även medborgarna är. Kommissionen godtar parlamentets ändringsförslag i den mån de är i överensstämmelse med den politiska överenskommelse som har träffats mellan parlamentet och ordförandeskapet och som bekräftades av Coreper den 2 maj 2005."@sv21
