Current Community law guarantees that Union citizens residing in a Member State of which they are not nationals have the right to vote and stand as a candidate in elections to the European Parliament and in municipal elections, under the same conditions as nationals of that state.

Das derzeitige Gemeinschaftsrecht garantiert, dass EU-Bürger, die in einem Mitgliedstaat leben, dessen Bürger sie nicht sind, das Recht haben, unter den gleichen Bedingungen wie Bürger dieses Staates an den Wahlen zum Europäischen Parlament und an Kommunalwahlen teilzunehmen und bei derartigen Wahlen zu kandidieren.
Für die Festlegung der Bedingungen für das Wahlrecht bei nationalen Wahlen und Volksabstimmungen sind die Mitgliedstaaten zuständig. Es ist daher Aufgabe jedes einzelnen Mitgliedstaates, die entsprechenden Vorschriften für das Wahlrecht festzulegen.
Auch die Kommission – nicht nur der verehrte Abgeordnete – hat Beschwerden von EU-Bürgern erhalten, die im Ergebnis der Ausübung ihres Rechts auf Aufenthalt in einem anderen als ihrem Herkunftsmitgliedstaat kein Recht haben, an nationalen oder regionalen Wahlen oder Volksabstimmungen in ihrem Wohnsitzmitgliedstaat oder ihrem Herkunftsmitgliedstaat teilzunehmen. Diese Frage wurde auch im kürzlich verabschiedeten Vierten Bericht der Kommission über die Unionsbürgerschaft aufgegriffen.
Die Kommission erwartet die Reaktionen des Europäischen Parlaments, des Rates und der Mitgliedstaaten auf den Vierten Bericht und wird diese wichtige und sensitive Problematik ausgehend davon erneut prüfen. Da die Teilnahme an nationalen Wahlen und Volksabstimmungen vollständig durch die einzelstaatliche Gesetzgebung geregelt wird, wären Änderungen an der Rechts- bzw. La legislación comunitaria vigente garantiza que los ciudadanos de la Unión que residen en un Estado miembro del que no sean nacionales tengan derecho a votar y a presentarse candidatos en las elecciones al Parlamento Europeo y en las elecciones municipales en las mismas condiciones que los ciudadanos de dicho Estado.
La definición de las condiciones de reconocimiento del derecho a votar en las elecciones y referendos nacionales es competencia de los Estados miembros. Por ello, corresponde a cada uno de ellos establecer las normas en materia de derecho de voto.
La Comisión ha recibido denuncias de ciudadanos de la Unión –no solo de su Señoría– que por haber ejercido su derecho a residir en un Estado miembro distinto de su Estado miembro de origen no tienen derecho a participar en las elecciones o referendos nacionales o regionales, ni en su Estado miembro de residencia ni en su Estado miembro de origen. "De huidige communautaire wetgeving garandeert dat EU-burgers die geen staatsburger zijn van de lidstaat waar ze wonen, het recht hebben onder dezelfde voorwaarden als staatsburgers van dat land te stemmen en zich kandidaat te stellen bij verkiezingen voor het Europees Parlement en bij gemeenteraadsverkiezingen.
De vaststelling van de voorwaarden die gelden voor het kiesrecht bij nationale verkiezingen en referenda, valt onder de bevoegdheid van de lidstaten. Het is dus aan de afzonderlijke lidstaat om goede regels inzake het kiesrecht vast te leggen.
De Commissie heeft klachten ontvangen van EU-burgers - niet alleen van de geachte afgevaardigde - die, doordat ze gebruik hebben gemaakt van het recht op vrije vestiging in een andere lidstaat, niet mogen deelnemen aan nationale of regionale verkiezingen of aan referenda in de lidstaat waar ze wonen of in hun eigen lidstaat. Este tema foi igualmente mencionado no recentemente adoptado Quarto Relatório da Comissão sobre a cidadania da União Europeia.
A Comissão, com base no Quarto Relatório, aguarda reacções do Parlamento Europeu, do Conselho e dos Estados-Membros e prosseguirá a análise deste importante e sensível tema. No entanto, como a participação em eleições ou referendos a nível nacional depende inteiramente da legislação nacional, na ausência de competência comunitária, para abordar esta questão, seriam necessárias alterações aos ordenamentos jurídicas ou constitucionais dos Estados-Membros.
Relativamente às eleições nacionais anteriores a 1 de Maio de 2004, esta questão dizia respeito a cerca de 5 milhões de cidadãos da União em idade de votar e residentes noutro Estado-Membro. No entanto, a Comissão não dispõe de informação actualizada sobre o número de cidadãos da União afectados no que se refere aos referendos nacionais sobre o Tratado que estabelece uma Constituição para a Europa."@pt17
"Current Community law guarantees that Union citizens residing in a Member State of which they are not nationals have the right to vote and stand as a candidate in elections to the European Parliament and in municipal elections, under the same conditions as nationals of that state.
The definition of the conditions of the right to vote in national elections and referenda belongs to the competence of the Member States. It is therefore up to each Member State to lay down the appropriate rules on the right to vote.
The Commission has received complaints from Union citizens – not only the honourable Member – who, as a result of exercising their right to free residence in a Member State other than their home Member State, have no right to participate in national or regional elections or referenda, either in their Member State of residence or in their home Member State. This issue has also been mentioned in the recently adopted Fourth Report from the Commission on the citizenship of the Union.
The Commission, on the basis of the Fourth Report, awaits reactions from the European Parliament, the Council and the Member States and will consider this important and sensitive issue further. However, as participation in elections or referenda at national level is entirely governed by national legislation, in the absence of Community competence, changes in the legal or constitutional orders of the Member States would be necessary to address this issue.

I gällande gemenskapsrätt garanteras det att unionsmedborgare som uppehåller sig i en medlemsstat där de inte är medborgare har rätt att rösta och stå som kandidat i val till Europaparlamentet och i kommunalval, på samma villkor som denna stats medborgare.
Att definiera villkoren för rätten att rösta i nationella val och folkomröstningar tillhör i medlemsstaternas behörighet. Det är därför upp till varje medlemsstat att fastställa lämpliga regler om rösträtten.
Kommissionen har mottagit klagomål från unionsmedborgare – inte bara den ärade ledamoten – som, till följd av utövandet av sina rättigheter att fritt vistas i en annan medlemsstat än deras hemmedlemsstat, inte har några rättigheter att delta i nationella eller regionala val eller folkomröstningar, varken i den medlemsstat där man är bosatt eller i sin hemmedlemsstat. Denna fråga har också nämnts i den nyligen antagna fjärde rapporten från kommissionen om unionens medborgarskap.
Kommissionen avvaktar, på grundval av den fjärde rapporten, reaktioner från Europaparlamentet, rådet och medlemsstaterna och kommer att ytterligare överväga denna viktiga och känsliga fråga. Men eftersom deltagande i val och folkomröstningar på nationell nivå helt styrs av nationell lagstiftning, i avsaknad av behörighet för gemenskapen, skulle det krävas förändringar i medlemsstaternas rättsliga eller konstitutionella system för att ta itu med denna fråga.
När det gäller nationella val före den 1 maj 2004 berör denna fråga omkring 5 miljoner unionsmedborgare i rösträttsålder som vistas i en annan medlemsstat.
