EU yder dog en præferentiel toldsats på 0 % til en række lande, herunder Ukraine, hvis der kan forelægges et oprindelsescertifikat (den såkaldte A-blanket) for disse forforme. For Ukraine betyder dette, at disse forforme i så fald er fremstillet af materialer med oprindelse i Ukraine eller i det mindste andetsteds i Europa. "Anfrage Nr. 43 von Johan Van Hecke () PET-Flaschen werden aus so genannten Vorformlingen („preforms“) hergestellt. In der Europäischen Union gilt eine allgemeine Einfuhrabgabe von 6,5 % auf diese Vorformlinge. Im Fall bestimmter Staaten, zu denen die Ukraine zählt, gewährt die EU einen Vorzugstarif von 0 %, wenn eine Ursprungsbescheinigung für die Vorformlinge vorgelegt wird (das so genannte Formular A). Im Fall Ukraine bedeutet das, dass die Vorformlinge aus Material hergestellt wurden, das aus der Ukraine oder zumindest anderen europäischen Ländern kommt. Dem Fragesteller ist bekannt, dass Vorformlinge aus der Ukraine mit dem Formular A (Ursprungsbescheinigung) zu so niedrigen Preisen in die Europäische Union eingeführt werden, dass es unmöglich ist, bei den derzeitigen europäischen Grundstoffpreisen derart niedrig mitzubieten. Es muss sich also um Dumping und/oder Betrug mit Ursprungsbescheinigungen (wobei Materialien aus Asien verwendet werden) handeln, mit dessen Hilfe zum Nachteil anderer Lieferanten die Einfuhrzölle umgangen werden. Ist der Kommission dieser Sachverhalt bekannt? Wird sie ihn untersuchen und daraufhin Maßnahmen treffen? "Ερώτηση αριθ.43 του κ. Johan Van Hecke () Τα πλαστικά μπουκάλια κατασκευάζονται από τα λεγόμενα προσχηματισμένα υλικά. Στην Ευρωπαϊκή Ένωση ισχύει γενικός δασμός ύψους 6,5% για τις εισαγωγές προσχηματισμένων υλικών. Σε μερικές χώρες, μεταξύ των οποίων και η Ουκρανία, η ΕΕ χορηγεί ευνοϊκό δασμολογικό συντελεστή (0%), εφόσον για αυτά τα προσχηματισμένα υλικά είναι δυνατόν να υποβληθεί πιστοποιητικό προέλευσης (το λεγόμενο Έντυπο Α). Για την Ουκρανία αυτό σημαίνει ότι στην περίπτωση αυτή τα προσχηματισμένα υλικά κατασκευάζονται από υλικά τα οποία προέρχονται από την Ουκρανία ή τουλάχιστον από κάποιο άλλο μέρος της Ευρώπης. Γνωρίζω ότι σήμερα προσχηματισμένα υλικά από την Ουκρανία εισάγονται στην Ευρωπαϊκή Ένωση με το Έντυπο Α (πιστοποιητικό προέλευσης), σε τόσο χαμηλές τιμές ώστε είναι αδύνατο με τις σημερινές τιμές πρώτων υλών να υπάρξει ανταγωνισμός σε τέτοιες χαμηλές τιμές. Επομένως, θα πρέπει να γίνει λόγος για ντάμπινγκ και/ή απάτη με πιστοποιητικά προέλευσης (χρησιμοποιούνται υλικά από την Ασία) ούτως ώστε να μην καταβάλλονται οι εισαγωγικοί δασμοί, γεγονός που αποβαίνει εις βάρος άλλων προμηθευτών. L’UE accorde un taux préférentiel de 0% à certains pays, dont l’Ukraine, à condition qu’ils présentent, pour ces préformes, un certificat d’origine (le formulaire A). Dans le cas de l’Ukraine, cela signifie que les préformes ont été fabriquées à l’aide de matériaux provenant du pays même ou pour le moins d’autres pays européens. Nell’Unione europea vige un prelievo generale all’importazione di tali preformati del 6,5%. Ad alcuni paesi, tra cui l’Ucraina, l’UE concede una tariffa preferenziale dello 0% qualora sia possibile presentare per tali preformati un certificato di origine (il cosiddetto formulario A). Per l’Ucraina ciò significa che, in tal caso, i preformati sono prodotti utilizzando materiale proveniente dall’Ucraina o perlomeno da altri paesi europei. L’interrogante è a conoscenza del fatto che preformati provenienti dall’Ucraina sono importati nell’Unione europea corredati del formulario A (certificato d’origine) a prezzi talmente bassi, che è impossibile – a fronte degli attuali prezzi europei delle materie prime – giustificare delle forniture a prezzi così stracciati. Deve quindi trattarsi di dumping e/o di frode in materia di certificati d’origine (utilizzando materiale proveniente dall’Asia) al fine di eludere i diritti all’importazione a discapito di altri fornitori. E’ la Commissione a conoscenza di tali fatti? Intende essa effettuare delle indagini e dare un seguito alla questione? Voor een aantal landen, waaronder Oekraïne, geeft de EU een preferentieel gunsttarief van 0% indien voor deze preforms een oorsprongscertificaat kan worden voorgelegd (het zogenaamde FormA). Voor Oekraïne betekent dit dat in dat geval deze preforms gemaakt zijn uit materiaal afkomstig uit Oekraïne of minstens elders uit Europa. Para a Ucrânia, tal significa, nesse caso, que as pré formas foram produzidas utilizando material proveniente do próprio país ou, no mínimo, de outros países europeus. É do conhecimento do autor que são actualmente importadas para a União Europeia pré-formas provenientes da Ucrânia, acompanhadas do formulário A (certificado de origem), a preços tão baixos que se tornam insustentáveis, tendo em conta os actuais preços europeus da matéria-prima. Trata-se, pois, de dumping e/ou fraude com certificados de origem (utilizando material proveniente da Ásia), de modo a escapar aos direitos de importação, em prejuízo de outros fornecedores. "Fråga nr 43 från Johan Van Hecke () PET-flaskor (av plast) tillverkas utgående från så kallade förformar. Import av sådana förformar till Europeiska unionen är belagd med en allmän tullsats på 6,5 procent. EU har dock en förmånstullsats på 0 procent på sådana förformar från ett antal länder, bland dem Ukraina, under förutsättning att ursprungscertifikat kan visas upp för dem (den s. k. blankett A). För Ukraina innebär detta att förformarna skall vara tillverkade av material som kommer från Ukraina eller åtminstone från något annat håll i Europa. Det har kommit till min kännedom att det för närvarande importeras förformar från Ukraina till Europeiska unionen med stöd av blankett A (ursprungscertifikat) till så låga priser att det med dagens råvarupriser i Europa inte går att leverera till sådana priser. Alltså måste det handla om dumping och/eller bedrägerier med ursprungscertifikat (varvid material från Asien används), med syfte att kringgå importtullarna, till nackdel för andra leverantörer. Har kommissionen kännedom om detta? Tänker kommissionen undersöka saken och följa upp den? Tänker kommissionen ta upp frågan till diskussion med de ukrainska myndigheterna och vid behov koppla in OLAF på fallet?"@sv21
