". I wish to say at the outset that this is really a question on public procurement and not on the Services Directive. The first point to note is that, as regards the participation in procedures for the award of public works contracts, it is not contrary to Community law that technical, architectural or construction companies holding shares in other companies which provide audiovisual services in one Member State, including the Member States of establishment, participate in such procedures in any of the Member States, including the one in which they are established. In order to deal with these kinds of potential barriers, Article 30 of the proposal stipulates that Member States shall ensure that providers are not made subject to requirements which oblige them to exercise a given activity exclusively, or in a manner which restricts the exercise of different activities either jointly or in partnership. However, exceptions are made for regulated professions and providers of certification, accreditation, technical monitoring, and test or trial services. For activities where multidisciplinary activities are authorised, Member States shall ensure that conflicts of interest and incompatibilities between certain activities are prevented, that independence and impartiality – when required – are secured, and that rules on professional ethics and conduct for different activities are compatible. ". Ich möchte eingangs feststellen, dass diese Frage eigentlich das öffentliche Auftragswesen und weniger die Dienstleistungsrichtlinie betrifft. Was die Teilnahme an Verfahren zur Vergabe öffentlicher Bauaufträge betrifft, so ist erstens anzumerken, dass Baufirmen, Unternehmen des technischen Bereichs und Architekten, die Aktien an anderen Unternehmen besitzen, welche audiovisuelle Dienste in einem Mitgliedstaat einschließlich des Niederlassungsmitgliedstaats erbringen, an derartigen Verfahren in gleich welchem Mitgliedstaat einschließlich des Mitgliedstaats, in dem sie niedergelassen sind, teilnehmen können, ohne damit das Gemeinschaftsrecht zu verletzen. ". De entrada he de decir que en realidad se trata de una cuestión relacionada con la contratación pública, y no con la directiva relativa a los servicios. En primer lugar, en lo que respecta a la participación en procedimientos de adjudicación de contratos de obras públicas, no es contrario al Derecho comunitario que empresas técnicas, arquitectónicas y constructoras que sean accionistas de otras empresas proveedoras de servicios audiovisuales en un Estado miembro, incluidos los Estados miembros de establecimiento, participen en dichos procedimientos en cualquiera de los Estados miembros, incluido el Estado miembro en el que están establecidas. ". Haluan todeta alkuun, että kysymys koskee oikeastaan julkisia hankintoja eikä palveludirektiiviä. ". Vorrei dire innanzi tutto che l’interrogazione in realtà riguarda gli appalti pubblici e non la direttiva sui servizi. Il primo punto da rilevare è che, per quanto riguarda la partecipazione a procedure di aggiudicazione di appalti pubblici, il diritto comunitario non osta a che le imprese di costruzione, gli studi tecnici e di architettura che detengono quote in altre imprese, le quali forniscano servizi audiovisivi in uno Stato membro, compreso quello di stabilimento, partecipino a tali procedure in qualsiasi Stato membro, compreso quello di stabilimento. ". Jag vill redan från början säga att detta egentligen är en fråga om offentlig upphandling och inte om tjänstedirektivet. Först och främst måste man komma i håg att när det gäller deltagande i förfaranden vid tilldelning av offentliga upphandlingskontrakt strider det inte mot gemenskapslagstiftningen att teknik-, arkitekt- och byggföretag som är delaktiga i audiovisuella tjänster i en medlemsstat, däribland medlemsstater där de är etablerade, deltar i sådana förfaranden i någon av medlemsstaterna eller i det land där de är etablerade. I gemenskapens lagstiftning om offentlig upphandling finns en uttömmande förteckning över de kriterier som kan leda till uteslutning av företag från anbudsinfordringar för offentlig upphandling.
